Traveling by AP
Hi. I have VAWA pending since 02/22 and ask to put I-485 on hold (abeyance) but there is no update since then. I have combo card from marriage AOS. Do you think it’s safe to travel outside the country? My lawyer said that’s fine but I’m still too nervous. Does anybody have any experience? I entered the US by student visa and kept the status until I filed marriage AOS. Should I worry about permanent bar or anything?

@Jack why wouldn't he travel? @Phuong I think you are good to go. I had same situation like yours and just came back a week ago. Avoid scare mongering as long as you committed no serious crime your lawyer is right.

Yea. only one difference is I got an email about holding my case in abeyance but most people get no response. That doesn't mean they are not holding your case. If they didn't hold it by now they could have scheduled you for an interview. Have a good trip and safe journey

oh. by the way don't stop checking your emails and account, in addition to that it took me 6 months to get response just for your peace of mind.

i totally agreed with jack phong…. that’s the first lawyer I hear said it’s ok travel especially when your vawa is still pending…. do you think about what if they deny your case while your away? and again it’s all up to the officers if they decide to let u back in the country…. don’t get me wrong it can travel on… but it’s not safe to travel on,they knew when u travel what if they make a decision because they know your away…. better be safe than sorry…. read up on the pro n cons

they Denied me when I came back to US in 10days Cuz when I was traveling they send me mail for second interview

ok I don’t really know much about this aspect of immigration but I’m commenting because I’m clueless like you, but I’ll say you should stay put in the USA, don’t go anywhere till u get what u want. don’t leave any space for denial. when u get approved you can go to India if you you want. STAY PUT!!!

I traveled with my Ap with no problems , no questions at all at the immigration they just stamp my Ap and said welcome back …

@M H. I’m not sure if it’s still valid because it stayed the same from the beginning and my lawyer told me not to worry about that
