Travel with pending i485
Hi guys,
I have a pending i485 asylum based and would like to travel abroad. I have refugee travel document but do not have advance parole.
Some lawyers have been stressing on the fact that travel abroad without Advance parole will deem i485 application abandoned.
Can asylees with refugee travel document travel abroad without having their i485 application abandoned?
Is there anyone here who have done this and still had their green card approved?

Yes you can travel abroad with your refugee travel document. you are still an asylee until your green card is approved.

i did travel abroad with my RTD for three weeks while my i485 was still in process came back and got my application approved 28days later

you need advance parole, however eventhough you have refugee travel document and advance parole, USCIS officer still can refuse to let you entry by their own discretion. if you don’t really need to travel abroad, please don’t do it, it’s not worth the risk, you are very close to have your greencard. @susi pras

I have a granted asylum and still waiting for my GC. And I have travelled 2 times with Travel Document without any issues.

@DIYAOUDDEEN SIBAWEIHI You should travel with a RTD if you are a refugee. That’s the travel document for only asylees and refugees. No one can use them for international travels. However, if you have another status and with a pending I-485 (also based on another status other than that of a asylee or refugee status); then, you HAVE to apply for the advance parole document, which is complexly different from RTD. Don’t get those mixed up. People with marriage cases often use the advance parole when waiting for a decision on their I-485. Please read the I-131 instructions.

@Willly Ong You are incorrect. And please stop misleading people. Refer to the I-131 instructions. Only refugees and Asylees can be granted a RTD. An advance parole is for folks with other status waiting for their I-485 to be adjudicated. But you can’t travel back to the US without any of those documents. You can’t only be denied entry into the US if you have a criminal background or a conviction on your record. If allowed to enter the US, you will be placed in removal proceedings. That can also be the case if you returned to home country due to your asylum claims.

@E Hopeful sorry about the misleading information, my point is, don’t risk it, whatever docs you have, USCIS officer still can denied our entry by their discretion. I’m personally is asylee and have a pending I-485, I will not travel anywhere before GC.
