it is not risky. that’s what the combo card is for. if you get a travel permit and if you don’t have any inadmisibility issues you should be more than fine

if you have h1b visa, no issues just use that to travel in and out if you have valid h1 stamping. if you are on 01, once you exit US then you have to use your combo card or advance parole to enter US and work on EAD and yiur o1 visa will be invalidated.

it’s generally recommended to use h1b or o1 when entering the country if you have them. It’s probably ok in your case though. Apparently when you’re entering with AP, they’ll need to pull you aside and you may spend more time at passport control when entering the country. AOS from tourist visa to eb1 is not very common though. you might want to trust your lawyer or get a second opinion.

last June I traveled with my advance parole no issues.If there is no criminal record you are good to go.They only check for criminal history when you entered the US.

I've traveled on my AP three times in 2022-2023 and didn't have any issues. They do pull you into secondary inspection but they didn't ask too much outside of standard questions.

nothing happens; you do not need a visa during AOS travel permit.

Traveled back to US on AP in January 2025 and didn't get any questions at 2nd inspection. At the first inspection they asked where we went, for how many days, and purpose of visit.
