Travel with Advance Parole?
Hello everyone,
I’m seeing a lot of news circulating about a new rule regarding Advance Parole travel.
Does anyone know what exactly changed? Does this mean we can no longer travel outside the U.S. using a valid Advance Parole?
I have a pending I-360 and I-485 and was planning to travel soon. Just wanted to see what everyone here thinks or understands about this new rule.

AP you can travel but if you
overstay on a visa that’s what the problem is trigger 3-10years ban
there might be an appeal of this BIA rulling
so let’s see what they will say next

@Sam S if u hv ever overstayed a visa or entered without inspection u can't travel anymore on AP ur Ap vil be still valid ull be able to travel n come back vit it but wen its time for ur green card application decision they vil deny it saying just coz u travel vit Ap which counts as a departure for people who hv overstayed n automatically trigger 3 year bar or 10 year bar

@love angel - I am planning for November. I do not have any other visa after I received the advance parole, and before I was on legal status. So I’m confused if I’m illegal with having Advance parole unexpired!

@shining star - What circumstances does it cover overstay? My last travel is in July 2024 and no questions were asked at that moment.

If you overstayed your legal entry it triggers the 10 year bar and might let you in but have effect on your adjustment of status.
if you entered illegally they might not even let you re entry,
that's my understanding.
is a rule that must overturned because is very Unfair for people who entered legally and we were married to US citizens .

@Sam S if b4 applying for any immigration benefits u wer in legal status then u can travel with out any problem on Ap its for people who came on example visitors visa overstayed for 5 6 years then got married applied for vawa coz of abuse n got Ap ead etc those people can't travel any more but if u hv maintained a legal status throughout ur stay in us u r good to go

n also people with overstay in past hv traveled with AP with no problem but going forward they can't travel anymore until they reverse the decision or something

I assume they will deny entry or green card interview time. they will say self deporting 😁I wouldn’t use AP. this days
