travel permit denied
Hello,,
I need help understanding why my Advance Parole (I-131) was denied.
I first filed I-130 and I-485 in 2021 based on marriage. In 2024, I had an interview scheduled. But before that, I had already filed for VAWA about 1.5 years earlier. My lawyer told me not to attend the marriage interview because we asked USCIS to transfer my I-485 to VAWA. We sent all VAWA documents.
My I-485 was denied because I did not attend the interview.
After that, my lawyer filed a new I-485 in September 2024 based on VAWA. I received a new work permit. But my new I-131 was denied. USCIS said I already had Advance Parole approved. That approval was from my old (denied) I-485, so my lawyer applied again. It was denied again.
I have no criminal history. I came on a tourist visa. Also I am not from any listed banned country.
Processing times are also getting longer. When I applied, it was 35 months. Now it shows 46 months.
Please let me know if anyone had a similar situation.

I haven't received it yet in hand, but last time they tried to deliver, they missed it. Today is day 124, and I still haven't received anything. My attorney submitted an e-request, but they said to wait 160 days. As you know, we can't wait that long, so I told my lawyer to call USCIS. I was worried they missed my RFE because i submitted Vawa almost 3 years so i was hoping that RFE because previous RFE was expired before 3 months, even though I don't know how they could have missed it because I haven't changed my address in four years and have always received all receipts and PFDs. Long story short, they called USCIS to inquire after 70 days, and USCIS said it was a PFD, nothing else today is day 124 still waiting.
also I saw your time line you received RFE what they were asking have you expedite your case ?

your lawyer kinda messed up had to hold marriage 485 as abeyance and no need to send new 485

I have told them multiple times to transfer my I-485 from I-130 to I-360, but he said that when they submitted the full packet of I-360 in June 2023, they mentioned a pending I-485 receipt. Still, after one year, USCIS scheduled me for an I-485 based on marriage. So, my lawyer sent them the packet again, describing that I had applied for VAWA and all, so USCIS rescheduled. My lawyer and I thought they had now transferred my I-485 based on VAWA, but after two months, they scheduled again. So, the lawyer did the same thing with all VAWA receipts and sent everything. This repeated every two months, three times in total. So, the lawyer was sending and calling USCIS about my case, but after the fourth time, they just denied it. The reason was that I didn't attend the interview after I had 60 days. So, the lawyer thought to file a new I-485. USCIS is very complicated nowadays to deal. I have approved my I-131 based on a denied I-485. Still, they denied my new I-131 because I had a previously approved one that expired in 2029. However, my lawyer said if the I-485 is denied, that means whatever approval was based on it also gets denied. But I don't know what's going on. Just frustrating all this situation we already betrayed by spouse and now by uscis waiting keep increasing months every month.

@june filter 2023 Having an approved I-131 based on your old I-485 which was denied has nothing to do with a newly filed I-131 and I-485 just to clear that up. I have a I-131 based on a previous marriage I-485 and also another I-131 linked to another I-485 based on Vawa just to mention. Secondly you should have gone to your interview and inform them that you filed a Vawa petition requesting they hold your I-485 in abeyance. Your lawyer adviced you wrongly. It is always better to go in person and inform the IO who would look it up on their system however some field office would tell you to file another I-485 as they won’t hold your marriage one in abeyance as it precedes your Vawa filing so it can’t stand. While others would hold it. I’m saying this based on previous administration way of doing things. Now back to your I-131 I believe there’s an issue in the way it was filed. Either all necessary supporting document was not attached however on the flip side they can’t deny you based on an already approved I-131 that is connected to a denied I-485 because as it is that I-131 is no longer valid even if it will expire in 3 to 5 years time. if you travel with it, you won’t be able to get back in as the basis for its approval is the denied I -485 that is linked to your marriage.

@bridges 5 I wish you were right, but USCIS stated on the denial notice I received that I am not eligible because I already have an approved I-131, while my I-485 was denied. We submitted all documents. They didn't mention any reason about missing documents.. Also, I told my lawyer that when I scheduled the interview, the lawyer said if I went, they would still deny it. So he thought it better to call them and notify them. I was on a conference call with them and a lady at USCIS. We mentioned everything, so they rescheduled the interview and then denied it. And we're already betrayed by our spouse, and we don't have enough immigration experience, so we just follow what the lawyer says, right? My lawyers said they're experts in VAWA, so we just have to trust, wait, watch, and pay fees😀

@june filter 2023 In most cases your I-485 would be held in abeyance if you go in person and if they won’t hold it based on the reason that your I-485 precedes your Vawa filing they will inform you to file another one but then you have the option to withdraw the already filed one you had with your I-130. Secondly like I told I have two I-131 filed with an old I-485 based on marriage and another based on Vawa. I am talking based on what I have and have gone through though I know all cases are different and can’t be weighed on the same standard. There most be a reason outside the fact that you have one already approve weither you received it or not. Evwn if you have it like I said in my previous post you can’t use it and if you do travel with it you won’t be allowed entry back into the States because the basis of it being issued is already denied rendering it void.

@bridges 5 Then you are lucky you have both approved. Nowadays, USCIS sucks. Also, my previous I-131 was approved. I know I can't travel on that because my I-485 was already denied. That's why I am trying to explain this to USCIS, but they are giving the same reason that I am already approved. They don't understand, even though we say and submit the same thing again and again that I have pending VAWA. I am not planning to travel anyway until VAWA is approved. But it's good to have a travel permit approved in case of an emergency; you never know.

@june filter 2023 I understand your point and I feel for you. I will suggest you wait instead filing another one let hope that you get approved or this administration leaves before you file another.

Hello! I have the same situation now. Did you refile a nem I-131 or did open a motion ? I was waiting for this AP for 13 months and it just got denied.

@Lerry Joh Hello Larry, I am waiting for my attorney's phone call. What should be done next after I update you. My attorney is also surprised and confused, even though they have been working on cases for 15 years and specialize in VAWA. They are a well-known attorney, yet they are still confused with USCIS nowadays.

@Lerry Joh They denied this time because I have an NTA for overstaying my visa. I have had one approved already, but now they said they can't approve it until a final decision. So, my lawyer is confused about the situation and doesn't know what to do. Even though they are saying they are experts ( Mounmita Rahman) in VAWA, they also lost their minds. Nowadays, we can't do anything; we just have to wait calmly and patiently for a decision. Let's see what will happen.

@june filter 2023 when did you get a NTA ? I requested a withdrawal of my previous I-485 about a year ago and they didn’t close on the system yet. I’m afraid to get a NTA…

@Lerry Joh I received NTA in august 2025 and had Master hearing was set for December 2025, but I hired a lawyer as soon as I received the NTA. He submitted all my pending cases documents, so they terminated or closed the case until I get a decision in November 2025.

@Lerry Joh Sure, but they sent me due to overstaying. What it mentioned in NTA. Did you overstay or how did you enter the USA? As long as your cases are pending, you are safe even if you get NTA but cannot travel outside of the USA.

@june filter 2023 yes, I did overstayed and applied for I-130, I-485. Applied for I-360 VAWA and a new I-485 after and requested a withdrawal for previous case…

@Lerry Joh yes I have same route as yours the only thing is different I have applied for U visa while I was robbed at gun point in 2019
