@G L, it shouldn't be an issue as I know a colleague who left an re-entered the U.S. on H1 and didn't have any issue. He just received his GC recently.

Would there be any issue traveling on AP with a valid O1? I have to travel to Germany early next week for a few days ? i have my AP valid for a couple of months more, but also in middle of an RFE for my birth certificate which I am in process of obtaining the paperwork.. any thoughts? can I also travel to India from Germany for a week and return ? might be faster to get the birth certificate or nabc documents myself.. any thoughts

@Jay D Yes, using H1 and not using AP maintains non-immigrant status.. If your H1 is valid and stamped, even my attorney says it is better to use H1. Bottomline here is, there is a myth that you can not travel outside US when your AOS is under process is wrong. You can travel but must make sure you do not miss any notices from USCIS

@G L can you tell somethi more about H1 stamping locally in USA and pilot program. H1 is for three years but every year i go back to my country for visa. now my visa is expired but H1 is valid and I don’t want to go back for visa. is there any way to do it locally in USA?

@Jay D Yes, they have started pilot program and I got my visa stamped here in the US. This program is currently valid for non-immigrants who last stamped either in India or Canada. The previous stamping must have been done during March21 to Aug 21 time frame. My last stamping was in India during May21.. so I was eligible. Just posted document through FEDEX and stamped passport arrived in 4 weeks! A Big relief! I think they may extend this facility for broader audience in near future..
