Transfer I-485 from Court to USCIS
Hi everyone, I am in removal proceedings and my individual hearing is about 3 weeks away. The attorney I consulted with says that the court won’t do anything until my I-130 is approved or denied by USCIS. I would like to transfer my I-485 from the court’s jurisdiction to uscis so that after my cancelation of removal, USCIS can adjudicate my I-145 soon after approving my I-130. Does anyone know where to find the form to request that transfer? do I just call the court? how does this work?! Thank you all for your kind support :) #removalproceedings

You can ask your lawyer to submit a motion to the court to move your individual hearing or put it in status docket pending a decision on your I-130. That was what I did for mine. And once your I-130 is approved, you’ll notify the court about it to be given a new hearing date. from there you can decide whether you want to continue I485 with the court or USCIS after the court terminates your removal proceedings

there’s no form. many people in purgatory when their case is terminated in the court but DHS never transfer the case from court to USCIS.. ur best bet if ur proceeding terminated to refile with USCIS. that’s faster. I know people still waiting for a year for their case the be transfer from court to USCIS
