Transfer i-140 from EB3 unskilled to EB3 Skilled or Professional
Hi everyone,
I have approved I-140 under eb3 unskilled and waiting for the date to be current.
My current employer is willing to sponsor eb3 skilled.
Can we transfer i-140 from EB3 unskilled from different employer to EB3 Skilled or Professional on my current employer?

It doesn't work that way unfortunately, because these petitions are based on the position you'll be filling, and not whether or not you qualify for other categories. So you'll have to start over for the new skilled position and get a new prevailing wage + labor market test + new perm for the skilled position then a new i140. However, since your eb3-unskilled i140 is approved, you do get to keep your priority date, if you go that route.

what can we do in the middle of waiting for the new i140? can we work for a skilled job?
