Time Procesing - Premium Processing
Hello everyone, USCIS received my response to the RFE on January 26, 2026. On January 28, 2026, the case status updated to “Case Is Still Being Processed.” For those who have been in a similar situation (especially EB-2 NIW), how long did it take for you to receive a final decision after USCIS acknowledged receiving your RFE response? If you were under premium processing, was your decision issued within the 45 business days, or did it take longer? Is it common to receive a decision earlier than the 45-business-day timeframe? I would really appreciate hearing about your timelines and experiences. Thank you!

mine was received on the 22nd of Jan and it still says received.

@n t Thanks. I’m not sure if they will take the 45 business days. (literally or they can take a decision before of the 45 business days) I hope they all be approved.

@n t The 3 prongs. only the official approved the advance degreee and substantial merit. I responded to the RFE point by point, directly addressing each concern raised by the officer and providing supporting evidence for every issue mentioned.

Once USCIS acknowledges receiving your RFE response under premium processing, the 45 business day clock resets from that receipt date, so in your case it likely restarted around January 28. For EB-2 NIW, many people do get decisions before the full 45 business days, sometimes in 2 to 4 weeks, but others go close to the deadline depending on workload and service center. “Case Is Still Being Processed” is a normal status after an RFE response and doesn’t signal a problem. In my RfE (form i140 for eb2niw), it was clearly stated that I should remove a response within 20 days of receipt at the uscis office. My RFE response was received on the 6th of February 2026. They added that if I don’t get a response within 20 days, I should contact a number in the RFE notice

@Nan ya I have never heard this before. please can you explain clearly what your RFE says and the instructions from the USCIS? Hopefully, you get approved.

@Nan ya @Gentleman Yes, I have actually seen this before. I personally know of one EB-2 NIW case where the RFE notice stated that USCIS would issue a decision within 20 days after receiving the RFE response. However, that language appeared to be an error or outdated template wording — likely referencing the old timeframe USCIS used to apply in certain premium situations. In that specific case, even though the notice mentioned 20 days, the final decision was not issued within that period. The applicant ultimately received a favorable approval, but it came on the 43rd business day after USCIS received the RFE response. So based on that experience, it seems the “20 days” language is not consistently enforced, and the actual adjudication timeline may still follow standard premium processing calculation rules. @D R Thanks for the explanation, that's sounds clearer. @Manifest Law When responding to RFE, should the petition be mailed to the initial service center (for instance Arizona Field office) or the Nebraska premium processing service center where the case was transferred to and adjudicated for RFE?

My EB2-NIW is processing under premium processing. First time on 44 BUSINESS Day i got RFE. then i submitted my response. Now its 20th BUSINESS day since my response is acknowledged. But no adjudication yet. Still waiting.

@nt accounting and finance. not STEM. But my friend is IT and he got approval in October 2025 (he filed Apr 2025 and he received a RFE)
