congratulations. can you tell us what about the at RFE was??
Stefani SFeb 5, 2024
Sure! It was the medical exam request + employee letter (thanks God I was already working on biotech company after 1 Month that I received the work authorization). they also asked about my current status and about my last publications/papers.
Mo aFeb 5, 2024
@Stefani S during I-140 I submitted my published papers. but for I-485 I did not. I submitted my I-485 with medical test. Thanks. did you apply concurrently??
Speed FavorFeb 5, 2024
congratulations! where you ever on crp?
Stefani SFeb 5, 2024
Nice! I also submitted my published papers during I-140 but they asked again if I had more publications (since it has passed 7 months after that). Yes, I apply concurrently.

Stefani SFeb 5, 2024
@Speed Favor no, no crp. It moved from “RFE response” to “new card being produced” / “case approved” after 7 months (when my priority date became current).

@Sunrise soon Sure! I just had 3 papers on that time (1 first as author and 2 co-author, but all in high impact factor journals) and 1 book chapter on my petition letter I-140. My attorney told me that the paper citations were important. (during I-140 I had 15 citations on google scholar and when I sent the response for the RFE I had 21 citation).

Congratulations @Stefani S . I didn't know an EB2-NIW applicant is expected to hold an active employment always? Could it be a problem if a niw applicant is seeking a new employment or unemployed when USCIS call for an interview? Anyone knows this?
Stefani SFeb 6, 2024
@T Y Hi, thanks! No, actually it is not mandatory to have already a job for NIW, but you need to prove your engagement to the field you apply for your NIW. In my case it was the biotechnology field, so as soon as I received my work authorization I started looking for a job on my field (before that I was focused on publishing papers and being in contact to my research partners). While you wait, I suggest be engaged to your field, like in a research group at University, attending congress, publishing papers... Of course each case is unique. But to demonstrate your intend is very important. God bless, have faith!

@Stefani S when your I-140 was approved, did you have to alert the USCIS that your I-140 has been approved for them to start working on the I-485/I-765? OR you did nothing but once your dates became current USCIS on their own began working on it
D FlexFeb 6, 2024
Did your I-485 move to the National Benefits Centrt after filing concurrent
Stefani SFeb 6, 2024
@D Flex It was everything “automatically” I did not have to alert them about the I-140 approval (since I apply concurrently). Right, my I-485 was moved to NBC and they started working on my I-485, then I received the RFE (medical exam and others stuff that I explained above in a comment) and as soon as my priority date (for decision) was current, the case was approved!
