Got denied in 2020, refiled and appealed at the same time. Appeal was remanded back to USCIS for a new decision, refiled case did one interview, missed the second interview, after multiple calls to uscis and to ombudsman on the remanded first case, got an approval on the second case. I wish I could say it was easy, but I’m just so grateful this journey has come to an end🙏🏽

How long it took the office that make the original decision to approve after the appeal was remanded back to them? My just relocated to back but still got no answer

Thank you, they didn’t do anything with the appeal. I had refiled, they approved the refiled case, but from appeal remand to approval was 10 months.

I did not know that i can refilled while the appeal was pending .you most spent a lot money ,time,and alot of energy .anyway congrats

Call as much as you can, I reached out to ombudsman some months back and they mailed me two weeks ago stating they would reach out to uscis about my remanded case. it was after that I got the approval. I totally ignored my refiled case because I got called for a second interview (which I missed cos we didn’t get the mail) and focused more on the remanded case, but they approved the second case instead, didn’t reopen the denied case or anything.

You have no idea, in between lawyer fees, refiling and appeal, consulting other lawyers to know why my case was taking so long? I don’t even want to think about it, I’m just glad it’s over

yeah I refiled and appealed at the same time because a lot of people said appeal takes a long time, but my appeal took about one year and 4 months for a response from the BIA

Approve the denied case while missing the 2nd interview ,they normally denied when people miss appointment ,they probably waived it.anyway thay God's job.

USCIS never acknowledged the remand, I had to send a copy of the decision to the ombudsman cos when I called customer service, they said they didn’t see the remand in their system

They denied cos they stated they didn’t feel we lived together, and we didn’t have enough bonafide evidence

Uscis mailed me a request for evidence notice to file an i601 wich i did in april and received a receipt notice that they have received And i aslo received this notification Sep 30, 2022 On September 30, 2022, the Administrative Appeals Office (AAO) transferred your Form I-601, Application for Waiver of Grounds of Inadmissibility, Receipt Number to the USCIS office that made the original decision on your case. That office will mail you our decision or send you a request if it needs something from you. When i tried to experdite my case Uscis emailed me that they have not received a response from the RFE they have sent me . The RFE was only for i601 . How did they fix that issue for you ?

Is ombudsman is different from Congressman ? If yes how do i contact them?

When I called and they said they didn’t acknowledge the remand, I reached out to ombudsman attaching the letter BIA sent with the decision. It took them two weeks after Ombudsman reached out to them to approve me

ohh ok, because I also have a remanded case which uscis have not done anything about it, I don't know if they will ever approve it

@addy I believe I have almost the same case with you…I am in removal process due to my first marriage that USCIS think was Sham, I got married again and file them on interview date I realize I was in removal proceeding since 2018 then I went to Court in 2019 and since then I haven’t been to court due to Covid they kept changing my court date for 3 years now and I was suppose to go to court last month which didn’t hold cos the website change from There are no hearing for this case…I was so devastated and frustrated then few days letter I receive a letter regarding my I-130 which was denied by uscis

I sent out an appeal in 2020 and here is the respond from the appeal Grant, Appellate Immigration Judge ORDER: The Petitioner appeal from the Director Denial of the Visa Petition filed on the behalf of the Beneficiary. In Response to the appeal, Council for the Department of Homeland Security has requested that the matter be remanded to the Director for further consideration. The Petitioner has not opposed the request. Accordingly, This matter is remanded to the Director for further consideration and for the entry of a new decision.

@A M, yes our cases are very similar. Only thing is I’m still married to the same person when my first case got denied. it’s either they reopen and approve your first case or call you for another interview on the second one.

@A M the letter was dated Jan 25, 2022. I called multiple times but USCIS kept saying it was not reflecting in the system. I had to reach out to Ombudsman with a copy of the decision from the BIA. When the ombudsman responded about them reaching out to USCIS, it took them two weeks to approve me after that.

@Addy my letter was dated 10/18/2022 should I give uscis couple of weeks bcos am unable to get in touch with any one over the phone with USCIS it’s always a machine and it’s so annoying when she hang up the phone when you call them

call very early in the morning and say you’ll like to reschedule an interview, it should take you to an actual person. my lawyer advised I wait atleast 6 months but keep calling or use the service of an ombudsman/congressman cos I got tired of waiting…

@Free Tudo yes, I refiled and appealed at the same time. appeal came back from BIA after 1 year and 4 months for a decision. and yes I refiled both I-130 and I-485…

@andy, pls help me with this situation of mine. my i360 got denied, they said no much evidence of bona-fide marriage. I gave all I got. now I appeal. no money as yet to refille,, but will save for that. but you know it's 33 days to appeal otherwise the decision is final. I stayed with my wife and I'm not in the lease bcuz it's a govt house and I involve in the lease the rent will go up. what can I do.

@Addy @ Sak pase Nap boule , i am in the same situation, my i-485 was denied, on the ground that the first underlying I-140 petition was denied. I made a written request to the USCIS NSC office to interlink & transfer the pending I-485 Application to the approved I-140 and my adjustment of the status application was pending at the time the request for transfer & interlinking. Now, I refiled I-485 and Mtr I-290B at the same time. I contacted with ombudsman and congressman for justice. Why has the USCIS Officer not linked our I-485 with approved I- I40 at the time of final adjudication?
