Terminate removal proceedings
Hi All! šŸ‘‹šŸ¼ I’m in asylum process since 2018, just went to one master hearing and since then no court date has been assigned to me. In April 2023 I submitted the I-130, I-485 and I-765 for marriage. EAD was approved, the I-130 was approved on Dec 21. But the I-485 was administratively closed due to the removal proceedings. Now that I have the I-130 approved I contacted my asylum attorney and he said that I have to wait until I got a court date, otherwise the court will not receive the motion to temrinate. Anyone with any experience or similar case please help on how to proceed. Thank you all!

sometimes you no have to wait till your individual hearing.just write them a letter termination your asylum case because your i-130 approved.!!

nope. get out from the court. it will keep dragging and dragging. whoever tells you to wait at the court, they probably just lucky. here’s what u need to do : 1. motion to terminate directly to the court (this is what i did ) OR 2. joint motion to dismiss with ICE attorney to the court ( ICE / opla ignored me for many months no response ) push ur lawyer to file motion to terminate directly to the court and don’t take NO as an answer. my lawyer did the same and I keep bombarded him once a week for 8 weeks until he can’t stand it and gave up and file it for me once it’s terminated : reopen the case with USCIS. do not stick with the court. get out while you can. plenty people here lecturing me and told me to stay with the court, they haven’t got their GC still and complaining while I already received mine 9 months ago

Either convince your lawyer to file joint motions now with ICE to terminate OR with court to dismiss due to your I130 approval or get another lawyer!!! Wait for another court date is insane, you can get another hearing and then get pushed again for years!!! Have the judge terminate/ dismiss and do a motion to reopen with USCIS, that is my humble opinion . A LOT of people will say go through court, but based on the number of cases sitting on dockets with all the immigration these days will be a really silly idea…! Get in front of it and don’t hold your breath waiting lawyers to give you the ā€œbest optionā€, at the end of the day, it’s your life, your future !! Best of luck .

my case is different but similar when it goes to court issues . so I approved for VAWA and got approved and my case with USCIS was administratively closed and I have to get through with the court . my lawyer just filed motion to re-calendar and then motion to close proceedings. so just waiting to see what next

@domino 23 @Steph Romano so my lawyer send the joint motion to dismiss, he did it through the email ICE-OPLA-NEW-PD@ice.dhs.gov since my case is in Newark, do you think I should take the copy and leave it directly in court and ICE window? Thanks for your help āœØšŸ™šŸ»

@Juan Osorio no point of sending it to the court if OPLA hasn’t approved it yet. hence ā€œjoint motionā€. get the OPLA approved first ( if they do ) and then file joint motion with them to the court

Juan! I was also put in removal proceedings In Newark by judge Yoonji Kim, by mistake since I came here for medical school with student visa !!!! First attempt was in person where I personally delivered at the window in 2 different floors and got my stamps as prove they were served , but with covid,they just kept pushing off the calendar every year, since judges were all getting moved to focus on border cases, then my lawyer kept going back and forth with emails like yours is doing now, and when ICE attorney kept ignoring, my lawyer went over his head and email his boss to get his attentionšŸ˜…ā€¦ And judge Alberto Raifkohl terminated August last year and I didn’t even have to go to court. As long as you have the emails and your lawyer is sharing it with you, you should be fine,hopefully they can agree between them to do the joint motion so you don’t even have to be put in the calendar šŸ™šŸ»

@Steph Romano yikes ! how the heck they put u in removal proceeding by mistakes ? who’s fault is that ? but glad is over for u. removal proceeding is no jokes. court is overwhelmed with the number of the case. also sometimes judge retired / passes away etc. I will take USCIS anytime than court

I was driving in Hudson County, NJ, on my way to school and got involved in a car accident , one of the cops checking my license, said I had a warrant and I kept saying no way, impossible ! Had to spend a night a local PD, then Marshall’s came and picked me up next am ,and took me to jail! Where I had to spend another night till I had access to phone and lawyer and a short hearing , they released me on a 20k bail, long story short, they were looking for someone with the same name and age, but my last name was her maiden name it was what seemed to have cause the hell in my life and almost ended a career I was yet to start, they issued a warrant under my name and missed out typing the actual person’s last name! Needless to say I have sued all departments involved , though I walked away school debt free after my settlement and with some chunk , all the embarrassment , having to keep fighting in court to have all resolved so I can become a physician for many years … I wouldn’t wish on my worst enemy . The worse part was how long it took to get me in court and get me out of removal even after it was their mistake!!!! The first judge passed away, case stalled, second retired , another year waste, third was a joke but I finally landed on a reasonable compassionate humane one. I’m so glad my court days are over!!!

@Steph Romano Wow that’s insane, and as @domino 23 says, how is it possible that they messed it up and then you have to fight for getting out of there. Unbelievable. I’m glad you’re now out of all that! and thanks for sharing you experience, this is a hard path and have the support of people is really appreciated. I will keep you guys posted šŸ¤žšŸ»āœØ

@domino 23 it’s terminated! It just dragged for a long time to get me a day on the calendar because my case wasn’t ā€œpriorityā€šŸ˜” Once they canceled for the 3rd time January 2023 I sued them also and it got terminated in August 2023.

@Juan Osorio thank you, yeah, I’m originally from Italy and when I tell that to anyone , they have a real hard time believing it, I’m lucky I had a lot of support from from job, school and family , otherwise I don’t know. But by sharing my experience , just goes to show you that there’s a way to work things out and yours will go way better , Godspeed !
