melina perezFeb 16, 2023
apply for an itin number or just file by yourself.
SOLA 🙏Feb 16, 2023
I did married filling jointly, not sure though
Jamaican princess 🇯🇲Feb 16, 2023
my husband filed by himself because I didn’t want to do a itin application and I don’t have a ssn.
DoIt ForMeFeb 16, 2023
I don’t want to do itin since it’s taking a while but I don’t want to file single. and married filing separate they asking for ssn or itin too. idk maybe I need someone to do it and not try myself lol @melina perez and @suechie clarke
DoIt ForMeFeb 16, 2023
@SOS 🙏 did you get itin or ssn for your spouse?

it’s always better to file as married & have the other party apply for an INTIN ….it takes a few months to get but you can always amend the tax return after the other party revive the ITIN

whoever the us citizen is has to file taxes as married but not jointly

does it affect immigration status of the beneficiary when you file single during the process or interview ?
waiting - January 2022Feb 17, 2023
@still waiting it could potentially cause issues yes since you are legally married

ohk it’s frustrating when you not together and most don’t know how to go about it and you know people want to file early to avoid delays in the tax refund

but can it be amended later after filling single ?
Jamaican princess 🇯🇲Feb 17, 2023
I was told by my tax agent tagt after I get my ssn I can amend for the the last 3 yr so am not worried.
DoIt ForMeFeb 17, 2023
@Suechie clarke who did you use to file and your husband filed single?
G SFeb 17, 2023
If you do married filing separately, do they ask for the spouse’s SSN?
DoIt ForMeFeb 17, 2023
@G S I tried on turbo tax and they are asking for ssn or itin but maybe I need a agent to file instead of trying to do it myself
Jude LFeb 17, 2023
you can file an ITIN at a tax payer assistance center in your city, they will do it then and there
G SFeb 17, 2023
@DoIt ForMe I'm going to try to fill it with an agent, as married filing separate.
DoIt ForMeFeb 17, 2023
@Jude L when I check online it’s stating that I’ll need original of spouse passport etc. what did they require from you? and what’s the fee they charge?
S AFeb 17, 2023
you can but it has to be done by mail you cannot e-file with an alien spouse with no SSN/ITIN. As far as I’m concerned, I would like to be proven wrong
Jamaican princess 🇯🇲Feb 17, 2023
@DoIt ForMe we used someone from liberty tax ( Albany NY) yes he did file single.

n zayFeb 17, 2023
we used taxhub in nyc. extremely smooth process. filed for an itin in order to submit married filing jointly. passport certification costed 50 usd. since my husband does not owe any tax, any delay in getting the itin will not be an issue according to the agent.
DoIt ForMeFeb 17, 2023
@n zay who did you pay the 50 usd to?
n
n zayFeb 17, 2023
it’s a CAA official qualified to certify my passport for the IRS, as I did not want to send away my passport for months and lose it (possibly).
DoIt ForMeFeb 17, 2023
@n zay yes that throw me off when it states the passport has to be mailed;I was like too much with lost mail going on of late lol but I wonder if they do for other states 🤔
n
n zayFeb 17, 2023
I’m sure there are certified officials to do it for you too. maybe call up a few tax agencies to ask around? good luck!

what if you are legally married and your spouse is not here in the USA and live in different country. That's no SSN or itin for spouse. Do you file taxes as single or married in this case?
Lauren BartonFeb 17, 2023
this is the situation I am in. my husband is coming to visit for 2 weeks in March and we're going to go to a tax agent together with his passport to file the w-7 for his itin number so I can file my taxes. really sucks because I now will have to pay someone to do my taxes when I've never done that before I always do them mysel, and I'll wait forever for my return.
k SarpongFeb 17, 2023
do not screw up your spouse’s case, kindly file jointly till the case is being approved: even though he or she do not have a ssn number, you can make him or her as dependent. kindly see a tax man for assistance.
k SarpongFeb 17, 2023
filing jointly is for the ones whose spouse live with them here, in the USA
DoIt ForMeFeb 17, 2023
@k Sarpong ok because my spouse live overseas so I’ll see a tax person
G SFeb 17, 2023
I found this on the IRS website In general, if you are a U.S. citizen or resident alien married to a nonresident alien, you are considered “Married Filing Separately” unless you qualify for a different filing status. If you pay more than half the cost of keeping up a home for yourself and a qualifying child or other relative, you may qualify for the head of household filing status.
rena dMar 7, 2023
Did you figure out how to file ?
DoIt ForMeMar 7, 2023
@rena b yes. but I haven’t mailed it yet. I did it myself on hr block. when you select the next step without social they ask you to select non resident alien. then it will tell you to print and mail. attach with the w2 for federal and state return attach a copy of the federal and mail
rena dMar 12, 2023
okay thank you . . I filed with hr block and I left my spouse social blank . but it still allowed me to efile . It says my return is accepted
DoIt ForMeMar 12, 2023
@rena b it shouldn’t let you without social 🤔
rena dMar 12, 2023
well it did , I put that he is a non resident alien and it still alkowed me to efile
DoIt ForMeMar 13, 2023
@rena I see. even better
DoIt ForMeMar 13, 2023
@rena b I tried and it did. I just had to put my payment in since I owe 😂. luckily I didn’t mail yet. hopefully they’ll accept it
rena dMar 13, 2023
I owe too 😂😂. they didn’t even give me a penny back lol
DoIt ForMeMar 13, 2023
