Hey! For VAWA applicants, if you’re still legally married but separated for over 2 years and providing for your child, are you able to file as Head of Household? instead of filling spepraly -married! I know in the future if you ever try to apply for citizenship USCIS looks at you taxes record and I just want to make sure I’m doing everything right and apply to my good moral character

file married filing separately as a head of household. I work at HR BLOCK and a lot of clients do that because they have been in a different address than their spouse for a year or more than a year.

I was reading online you can’t file HOA until you divorce you spouse because that is consider fraud! so wondering if USCIS might question if I ever filed for HOH even though we haven’t been together for years. but IRS only gives you one option HOH. I heard USCIS might consider it that you are aren’t being honest.

under the law after living a year in a different address even if you are not divorced you are considered legally separated then once you file for the divorce then you do divorced. But read about your state because every state is different because the state where i got married after a year formality recognizes legal separation.

I have same situation, but my Laywer advised me to keep filling Seperate , because the husband has arleady as a head of house even though not leaving together for years.
Can anyone in Florida advise any affordable Attorney/Laywer to assist on filling divorce please. I tried to look but most of Attorneys I consulted just ask 3000 upwards that split by two. Thank you
