for those of us waiting for a green card or EAD card and we’ve been here for over a year , are we non resident alien ?

if you're waiting through marriage you can submit an "election to be treated as a resident for tax purposes". you'll need to include a cover letter saying your doing so. google the text in "" to find out more info
