Hi all I am a permanent resident and filled 1-130 for my wife who lives outside of the Us. we are waiting for descion about I-130. we married on April 2021. should I file my 2021 tax as married jointly? if yes, how can I get her tax identification number ?

I don’t think you can file jointly as long as she doesn’t have a SSN, try to contact TurboTax

No as long she lives outside of the USA you can't files your tax as married, Do it as single

nooooo! file married filing separately because you are not single, you are married. you need to file married filing separately and in the box that asks for her tax ID you will put NRA (non resident alien). who ever said you can file as single is dead wrong. please get informed before making any decisions. you might have to explain later why you were filing single when you were legally married.

Agreed with what Luisa stated and I got the same answer yesterday from a friend of mine who is working in this field for the last 35 years.

@Luisa Fernandez thank you. yes, it makes sense to file married. my idea is that I can get more refund if I file married-jointly. what about filling w7 form to get tax identification number for my wife and use that number for filing married-jointly

Luisa is correct. That is what I did last year...married, filing separately and writing in NRA for his ID. IRS agent said to do it that way.

How is the idea of getting wifes tax identification number and then filing as married filing jointly. wife doesnt have any income abroad. can yall please advise on this?

@patrik I did extensive search and several tax expert. you can file as married jointly. you need to fill W7 form to get a ITIN ( TAX IDENTIFICATION NUMBER) for your wife. you mail the form along with your tax return documents to IRS. you cannot electronically file .
