suggestion needed
I am a US citizen. My husband’s I-130 got approved in June, 2023 and currently it is in NVC for Consular processing. We already paid the fees and submitted all documents.
But my husband is now in USA with B2 visa, can we do Adjustment I-485 here now or do I need to file I-824 first?
we are confused what would be the better option.

I -824 form instructs Uscis to send your petition to NVC but if he is already here send a request to NVC to send your petition back to Uscis and file I-485 along the I-130 approval notice.

I would not do that it can backfire. Unless you had a life changing event happen it’s considered immigration fraud to come in on a travel visa with the intent to stay.

you can always just do a consultation with an immigration lawyer to get advice on how to move forward

That shows fraudulent intent, your lucky that when he was finger printed upon entry that his immigrant request did not show up, but he needs to return and go through the intended channel applied prior. It’s tempting to stay but don’t take any chances that can cause more issues.

but you did not apply for him through AOS while in the u.s hence the reason why it’s at NVC. If you can prove he had no intention of staying maybe you can am just giving my opinion as I also have a B-2. And I know from a lot of research that it’s not the process, and a lawyer may take your money and not be 100% honest.

He should go back to his country and go through the consular procedure as planned. You’re halfway there; don’t mess things up for yourselves this late in the game.
