Status of abuser !
Hi guys :) When I applied for Vawa I didnt have any proof to show my ex wife us citizenship ( no passport no birth certificate). My lawyer and I provided info of my abuser: first/last name , SSN, Dob / place of birth and expired DL and we asked USCIS to verify her citizenship. Now, was anyone in similar situation and still got RFE or USCIS can easily verify her info ? In case i get RFE i dont know what else to provide to show her citizenship. How easy/hard is for uscis to verify? She has US passport ( she is us born) but i dont have picture. Can uscis easily verify her passport records even if they are protected under Privacy act, I think that would be easiest way or they do via other methods? Thanks πŸ™ƒπŸ™ƒπŸ™ƒ

@carlito reyes I was in similar situation and asked uscis to verify it internally and they did. my vawa got approved in June. don’t worry.

@Ena 22 Great thank you :) Did spouse ever filed adjustment of status or I130 with you or not? asking because in that case DHS will already have spouse info in their system which is not case with me

@carlito reyes no, I never filed 130 since I already had a valid status. I directly filed 360 after separation.

@carlito reyes No problem . When I filed my case, I didn't have my ex's documents either. So, with the marriage and divorce certificate, they verified

@carlito reyes uscis understands vawa applicants may not have access to their spouse's information so there is some leniency there. Another thing you can do if they ever send a rfe for that is to get notarized letters from others who know of their citizenship status

Thank you all. I know that burden to prove is on our side but wouldn be just easier for USCIS to request and verify abuser passport records from Department or State , and make easier for everyone 😏 Those records have picture of their passport, their birth certificate / naturalization certificate , they can see everything at one place ( if abuser ever applied for passport ) and not like this us having to strugle to provide. Thank you all
