@nita n since you already submitted your application before your wedding, how do you plan to file for your spouse? the I-130 route? I asked cox I’m in the same situation, thinking whether to wait and find another way to go out of the country to do the wedding and then come back to file for both of us together or if I should just do mine now and go do the wedding afterwards and file I-130? which you think is better and faster?

@the_ 9jaboy tricky situation for us both. I decided to file mine for work authorization purpose. Since I am current this month, I find myself at the mercy of uscis. Hopefully I don't get approved this month. This way, I can add my spouse as a derivative. If I am approved, then we will go through the i130 route

@nita n thank you for your response but wait are you saying it is still possible to add your spouse as a derivative when you have a pending I-485, even though the EAD has been approved. Like I can submit the paperwork for AOS and get my Advance parole to go get married and then since my AOS isn’t approved yet, I can request to add her after returning from the wedding ceremony? I want to get more clarity on this please

@the_ 9jaboy yes you can add a spouse to your pending i485. As long as the wedding date is before the approval date. You can even submit an AOS for your spouse after your approval. The only condition is your marriage date must be before your I-485 approval date. This is what I am currently in the process of.

@nita n oh wow I didn’t know that. thank you so much for the info. so it means it doesn’t matter if you file the form of your AOS being single, as long as the marriage happens before AoS approval then we are good?
