Good afternoon. I am seeking advice from individuals who share similar life experiences. My I-360 was approved back in September; however, USCIS was not granting deferred action at that time. In November, I reached out to my attorney to ask how to proceed regarding the new deferred action updates. She stated they were unsure how to move forward since the process was so new. After receiving no response for two months, I was finally told that the only way to be considered for DA was by re-applying for a Work Permit (I-765). I already have one denied I-765 from my initial filing in April, and I am concerned about another denial. I have noticed many others are submitting a G-325A instead of an I-765. Furthermore, the paralegal on my case has left the firm, and I have not had a reply from them since January. Although I signed the I-765 paperwork and provided new photos months ago, I have not received a receipt number or any communication. As a college student with limited funds, I cannot afford a new attorney. I am under a lot of stress and I am aware that everyone is undergoing such stress as it it not a case exclusive to me; nevertheless, I would appreciate any guidance on how to handle a non-responsive firm or this specific filing process. Thank you for your time, and my apologies for such a lengthy paragraph.

I am pretty much in the same boat. However, my lawyer resubmitted a form g325a again and i’m waiting on that. Your “lawyer” was right about one thing: it’s a new process and no one has experience on what’s the best way to do this. With that being said, i would say that it wouldn’t hurt to try submitting form g325a as it is free. I know it is hard doing it without any help but i feel like it maybe would be the best thing for u to do in your current situation.

@Fabiano H Silvestre Thank you for taking your time and sharing your thoughts on this matter. I will for sure submit one as it does not seem difficult at all, and seems pretty straight forward. I am just a bit concerned about doing something incorrectly and triggering a removal order. Needless to say, thank you, and good luck on your case!

I’m in a very similar situation. My I-360 (SIJ) was approved recently, but I did not receive deferred action or any clear guidance from USCIS. My work permit is expiring, and I feel stuck in this gap where I have approval but no way to legally work yet.
It honestly feels like a trap — you get approved, but then you’re left without status or clear next steps. I’m also trying to figure out whether to file I-765 again or submit G-325A like others are doing.
If anyone has actually received deferred action or a new EAD after approval, please share what you filed.
