Should I proactively send USCIS new VAWA evidence, or wait for them to issue an RFE or hopefully an approval?
filed my VAWA I-360 back in August 2021 and responded to an RFE that December, but it’s still pending. I’ve now got new psych notes and witness letters. Should I send this extra evidence to USCIS now, or just wait for another RFE or hopefully an approval? I’m honestly nervous and anxious. Looking back at my files, I see my psychiatrist talked about my mental health but didn’t really detail the abuse from my ex—it’s more about my miscarriage, family deaths, and other trauma. I’m worried they won’t see him as the main source of the abuse. What’s the smarter move here?

Vawa cases are unlike others. You don’t just send in unsolicited evidence in and if you do, you need to do it with a copy of the informational letter sent to you. Anyway i would advice you await them request for it before you do because it can also get misplaced in piles of documents. So wait for them to send you either an RFE requesting for more evidence rather than complicate issues.

you have to ask help for our congressman or ombudsman so that they will study your case, wait and let them send you an rfe if it needed.

because if you get approved in your vawa case during your interview for greencard you can still defend yourself or bring it in to them incase they will ask you.

In my opinion, either way, more evidence of abuse will strengthen your VAWA.You can send the additional evidence, it won’t hurt your case

I have sended throw my lawyer more and more evidence throought the 4 years because the abuse was continuing after I broke up so I believe is good
