Sharing my case details (EB1-C)
Hello, just wanted to share my experience and maybe get some insights from the community. PD is August 2020 for my I485. Both I485 and I140 were applied at the same time, with I140 approved March 2021. EAD approved in Dec 2020, and figer prints also taken in Dec 2020. currently waiting on final I485 approval. Texas Service Center. I have seen a few posts in a similar situation and Texas backlog seems to high. My case will out of processing time in around 3 weeks. No RFE asked, and submitted medicals back in 2020. My plan is to ask a congressman to make a inquiry when its out of processing time, with a letter of support from the company. Biggest concern is being out of the 180 days of EAD extension (next May). Any one have a similar experience, Any tips? Should i only focus on expediting the EAD renewal or just resquest to review my I485? Thank you for your time, hopping we all get approvals.

I have similar case in Nebraska and still waiting no rfe and raised a few SR and nothing happened so far

we are waiting also (since June 2020). did you hand in your medical with everything? we got a request for that last summer and handed it in August 2021 but are waiting since (5.5 months now). we are trying to expedite now.

I did not send medical with my file and interfiled it last year around July but noone could confirm it ascreceived , very tired of waiting and really do not know why all friends file after me got their GC and me still waiting for rfe

it's likely that they ran out of visa numbers for eb1c category or maybe they want to waste more this year.. they are def reviewing and approving eb1-1, eb1-2, but not eb1-c ..

i did medicals early as it was requested by law firm. i believe they sent it upfront with original forms in August 2020. Not sure if there are different ways to do this.

if they have been sent as a pack with everything in the beginning you should be fine. if you randomly send it inbetween without a RFE I would inquire if they received the medical. otherwise it’s unfortunately waiting for now.

and the visa numbers restarted in November. I don’t think they ran out by now.

@sara numbers restarted Oct-1 and they have issued a while bunch of eb1-1 and eb1-2 GC since then through NBC. additionally they randomly processed a bunch of eb1c earlier this year to make their averages look good. they are moving numbers to eb1-1 and eb1-2. they announcement clearly says that 1 and 2 have more visas that 3 which is eb1-c. they are encouraging people to move up into 1 and 2 so they can issue those issues in those buckets.

@PK how can you move from EB1-C to EB1-1 or 2. these are different categories. this does not make sense to me. can you provide where this announcement was done?

I have seen some random posts between Eb1 getting approved for dec 2020/ jan 2021 tsc filings. why they are not prioritizing May-Sept 2020 filets? really frustrating.

I filed concurrently i485 and i140 on Feb 2020 and I’m still waiting :( I’m with TSC but I can’t see what type of EB I have. Do you know where I can check? Also, I’ve already raised multiple service requests and my congressman sent a letter a month ago but nothing has changed so far :(

LS what was the basis for your petition? EB1 is for “Extraordinary ability”, research professors or executive/manages. EB2 is for Advanced degrees (so you need a master minimum) or you have a National Interest waiver) and EB3 is other professions (if you have a bachelor degree for example). EB3 takes longer because it needs a labor certification, which is another step in the process.

@LS: Did your i140 get approved yet? ours was super quick (December 2020 approval after we submitted in June 2020) but the i485 part is taking forever.

@Sarah Supposedly yes it is approved. I got a letter via mail saying it got approved on April 2021 (14 months later) but it never updated online.

my guess is that it will take still a bit. we should be ahead of you EB1-1 and are June filers and nothing yet 😭

EB1C filed October 2020 concurrently Nebraska pending I140 and I485 BIO completed May 2021. no update since.

they are not approving GCs.. they are only approving EADs and spouse visas that come with work permits.. idea to get aa much work force as possible in to meet the demand and bring down inflation..

with the new bill, GC numbers will not lapse and be carried forward automatically.. all the more reason they don't have to rush on issuing those anymore..
