adding child on I130 or separate i130
I have a question. I was LPR when I file I130 for my wife about 2 years ago and I just had new born on July. A month ago on August, I became USC and my wife I130 is still pending, Do I need to file separate I130 for my child or I can add him after I130 approval. please share your experience on this matter

Hello, if you need to make a separate petition for your child as he automatically leaves the petition by becoming a citizen

as a minor child he will get his visa with your wife. you just need to report birth outside USA. if you had citizenship at time of child birth then your child can get citizenship automatically just by reporting birth outside United States you can do that by reporting it to local embassy where the child is born.

@skc kc yes you need to file seperatley i have same issue i filled 1 petition for my wife and daughter after 18 months i bacame usc and they approve only my wife and i reapply for my daughter and i am still waiting for my daughter its been 20 months. hopefully she will approve soon.

@skc kc since you've now become a U.S. citizen, you will need to file a separate I-130 petition for ur newborn child. When u were a LPR, ur child would have been considered a derivative beneficiary, but as a U.S. citizen, each family member (including your child) requires an individual I-130 petition. You can request to expedite the child's case so it aligns with your spouse’s immigration process.
