Separated, but still legally “married.”
As a US, I am getting ready to petition for my brother, but recently I realize that although he doesn’t live anymore with her spouse, they are still legally married. They’re separated but married legally and with a 25 years old daughter who lives currently with her mother.
I would appreciate your comments on how should I handle the case, and what documents do I have to submit for his i130 application. How do I move on?

First apply online visitor visa B1/B2 , send the requirements like invitation to your brother that u want your brother to visit and meet u here in America you will get formats for this on internet.show sponsor ship like pay slips or bank account to prove that he will stay here on your expenses and prove them your brother is having strong ties in his home country to return back don’t show much personal details about his wife and children it better in u r case to hide don’t talk much about it .

Thank you, but I still don’t understand your original answer. My brother is the one to come, why do I have to fill out the forms? Why do I have to apply? If he applies he has to prove he has job to visit US and go back to his country.

first thing formDS 160 is a application form with fee to get visa any one can apply either u or your brother.second thing if u want that u r visa should be approved you should always show the intention to return to home country

correct you r a citizen u can apply for your brother under category f4 it will take long time to get your pd current . it depends on country visa availability. so it’s good to apply and wait for years and years .

I have been doing some reading on the website and what you sent me before. Now I understand, but then as a US. citizen I don’t have to apply using the visa link you sent me previously. He can apply using that link if he wants a visiting visa. I don’t need it. So basically what you said, if he comes to the US under a visiting visa, once he is here I can file for him under the F4 category (i130). Are we clear now? Will it not be a violation of the law? Will this not affect me for encouraging him to overstay with a visa type or category (B1/B2) that is only for a short term visit? Thank you again for all your counseling. I appreciate it.
