Second Expedited Request Denied
I wanted to share with you guys that my second request was denied. the first was based on Humanitarian Reasons and second based of financial hardship. my receipt date is 4/26/23. I have emailed everyone and filed an appeal for my first denial (haven’t heard anything). My only option is to sue USCIS. I believe I will wait until May to do it. I just don’t want to continue to loo law more time in this process. I wanted to try everything just in case one of those steps would advance my process. the I129F didn’t do anything for my case. when one is filed USCIS just go was by the I-130 processing time.

That’s sad. You filled I-129f or I-130? I mean it’s only been almost a year people here have been waiting for far worse. They usually don’t expidite cases unless it’s an emergency I believe. Not sure what your situation is but if its worth suing then hope it works out for you.

I feel you. similar timeline. but I’m not sure you can sue if you’re not outside processing times. most everyone waits at least a year. you’ll probably get appvoed over the next month. good luck!

listen if you have the 5 grand to sue go ahead its a privilege to sue uscis theres people including me that have and still are waiting (almost 4 years) keep in mind that suing does not guarantee a positive outcome good luck

@Lolo Duru no attorney. I have always completed my immigration processes myself (daca and family based). I’ve never had to wait this long for an approval. it was always 6 months. but if or when I decide to sue would be with an attorney. I believe the government is using most of resources on the asylum seekers which is very unfair for us US citizens.

my case is April 29, 2023 . I’ve seen that they are working on April cases now at almost every SC if not majority . we haven’t hit 1 year yet so I would try to remain as patience as possible because we can’t really do anything until it is outside of normal processing time which is 14 months . I’m sorry you’re going through this , we all feel the same .

the normal processing time for a i130 is 11-14 month so your case still ontime if you sue USCIS I think you'll lose the case

@Jay II one month exactly. One of the agents told me Tier 2 agents have to review the expedite request now which I thought was a good thing for me. I had to try!

you can send through myuscis.com account and upload your request letter and evidence there as well.

you can sue as long as your case is over 180 days.
