RFE: Written request for an exemption of the two year residency period.
Please I need a help on this: You are receiving this notice because U.S. Citizenship and Immigration Services (USCIS) requires additional evidence to process your Form I-485, Application to Register Permanent Residence or Adjust Status, filed under section 245 of the Immigration and Nationality Act (INA) based on being the beneficiary of a family-based immigrant petition. Please read this letter carefully, follow all of the instructions, and provide the requested evidence and information in order for us to make a final decision on your case. Include duplicate copies if you are requesting consular notification. What You Need to Do You must provide the following information in order for us to make a final decision on your case: Submit a written request for an exemption of the two year residency period. USCIS records reflect that you married your spouse while they may have been in immigration proceedings. Section 204(g) of the Act states that a petition may not be approved to grant an alien immediate relative status based on a marriage entered into while immigration proceedings are pending against the alien until the alien has resided outside the United States for a two year period after the date of marriage or the alien establishes by clear and convincing evidence that the marriage was entered in good faith, was not entered into for the purpose of procuring the alien’s admission as an immigrant, and no fee or other consideration was given for the filing of a petition.
