I have sent my response 210 days ago to Sacramento FO. recent SR came back with the answer that they are waiting for the result of my security check!

@Amy Tava , but this is on your 485 form correct? not I 140! my RFE is about my I140 form!

@Fernando It’s going to work I have seen others waited longer than 140 days after sending their response to an I 140 RFE so it is not unsual. I am not sure why your lawyers are advising against opening an SR but I think you are eligible to do so after 60 days of sending your RFE response. They may not respond to your SR but I don't think it should harm your application in any way unless there is something going on at USCIS we don't know. As for the PP I think its a choice between reducing the number of days you go through stress while waiting and potentially gifting USCIS $2500 as you may be close to a decission. But like the SR I don't think upgrading to PP should harm your application. Did your lawyers tell you why PP and SR are not good ideas?

@Selith H , they say that a SR can cause a harm in my app because we’d telling uscis what to do. and regarding the Pp, they said to not upgrade after the RFE response, that this has to be done before getting a RFE!

@Fernando It’s going to work I understand the situation with the PP but I still don't see how the SR will affect their decision unless their decisions are based on testing the applicants patience rather than on the merits of the case because their own policy guidelines state what they need to do when they receive the response to an RFE. Well I hope everything works out for you.

Just be patient. Use the lawfully analysis to check your current position in the queue. This may help you ease the mental torture..

@Che Pe I responded to the rfe on my 485 almost 8 month ago and 485 is still pending! no answer even after e-request as my case in out of processing time!
