RFE requesting for birth certificate
I sent a copy of my birth cert to USCIS when filling for my I-485,but I got an RFE from USCIS requesting for a copy of my birth certificate. Can I send them the same copy of the birth certificate when I was filling my I-485?

Yes. Also, check if the birth certificate you previously sent meets the DOS reciprocity list for your country to be sure it's acceptable.

check list birth certificate should in English. birth certificate should be endorsed by government authority. Entry of birth should not be late. if the birth was entered late please provide the affidavit of your mother and father. and also send them any other government issued document which shows your date of birth for example your government driving license, educational certificate which is with data of birth. please don't send the same birth certificate alone which you have already been sent must send some supporting document which I have already been explained to you .

what’s your country of birth ? My spouse got the same RFI even though we submitted so we ordered a new BC from UK government which they sent with their register stamp and we submitted that with the RFe

congrats! you should be 2-4 months away from approval now, almost there! took mine 2.5 months after I sent them the birth certificate.

@J Dalton same country. They prefer the older version not recent (biometric) birth certificate. The issue date should be less than a year after birth. I sent them both versions.

Thanks for the response @R A . I don't have the old one (the one with less than a year). I guess I would have to send them another copy of the birth cert I have recently.

@J Dalton No, Don’t send the recent one. Ask you lawyer regarding best option. In which city were you born? Reach out to the regional hospital for an affidavit.

@J Dalton I responded to RFE in April. it’s been almost 3 months and I haven’t heard back anything. The status says “ Response to RFE received” as long as your birth certificate is stamped by the registry office you should be good. check with you attorney before you respond. don’t send the same unless that’s all your country provides.

@Guma G how can you be so sure it will take 2-4 months after sending BC we will get approval? I sent my spouse before 3 month and I been current for EB2 since April. I still don’t have any good news
