happened to someone I know, they never got their rfe and opened a request to get another copy. USCIS sent it 5 days to the rfe deadline and didn’t provide an extension. the rfe was bogus and you could clearly see the officer did not read the petition as he was referencing things that were never in the petition to begin with. it was ultimately denied. they decided to refile without changing anything in the petition and it got approved the second time. if you decide to appeal, non-receipt of the rfe will not be a good reason to reopen case because USCIS just sucks all round.

It is best to just work on refiling and not worrying about this denial. Maybe your petition wasn’t great to the officer. Just move on and file a new one. Good luck. Do you live in USA?
