RFE issued but received NOID
I see RFE was sent for my I-140 PP six days ago on USCIS case tracker, but yesterday I got NOID in the mail. It still shows RFE on the system. On December 13, they cancelled RFE in the morning, but later the status changed to RFE again, but eventually after 5 days I received NOID with 3 accepted criteria of out 10.
Thoughts?

did you file through Attorney? what was the NOID based on? did USCIS reject your claim on 3 criteria?

Yes my attorney filed the petition, final merits (“substantial” international or national acclaim) are the concern of the NOID. USCIS admitted that I met 3 criteria.

when you meet the criteria threshold but fail in the final merits aspect I.e. no proof that you have sustained acclaim and at the very top of your field, they issue a NOID.

yes if you meet minimum 3 criterias, they issue NOID if the officer feels that you have not met the Final Merit Determination, i got the same, luckily my attorney was able to respond to NOID with enough supporting docs and it got Approved, so dont loose hope
