Hi All, In December 2022, we started the AOS process through my greencard holder spouse. In order not to risk my valid visa, we applied without waiting for the 2022 tax return. My husband's tax return for 2021 was below the desired rate, but we also showed the cash that had been in the bank for a long time. RFE came about our file and it was stated that they could not determine whether my spouse's sponsorship was sufficient, and new evidence was requested regarding the financial situation or you could add a joint sponsor. My husband has already filed the joint tax return for 2022 and is is well above the desired amount(56K). We still have cash in the bank. In this case, would it be sufficient to send my husband's tax return for the year 2022 and our bank account to RFE, or do we have to find a joint sponsor? Our lawyer said that since we applied in 2022, the tax declaration for 2021 is important, and if we do not present a joint sponsor, our file may be rejected. If we reply to RFE with my spouse's 2022, can they reject the file without requesting other RFE? #I485 #rfe

your tax returns 2022 will be sufficient. in 2021 did he get a new job? is 2021 income low? you mentioned you had not filed it prior to submitting

My husband just moved to Usa in 2021 August, that's why his earning was around 21K at the 2021 tax return. We also sent statement letter at the application to explain that situation and included the job letter,bank statements,his recent paychecks but probably they didn't even look at anything except the tax returns.

Is there a possibility to reject to Aos without sending any other rfe, like my lawyer said?
