hey I checked the package my lawyer sent to USCIS and I864W was attached to the packet as well. is there a reason why you shouldn’t fill the form out?

@Mrkvica M. I hope so too. But in the mean time, I will download and fill the form, add a copy of my i360 approval, my recent tax return and send it by next week that’s if the officer doesn’t call for the info pass.

@remain anonymous I don’t know why we didn’t include it. I’m sure my lawyer doesn’t even know it should be part of it. He has handled so many vawa cases and 485. He would have told me to add it with my package if it’s something he’s aware of. Did you add any supporting document to the I-864w? That’s what I’m trying to search online now. the only thing I’m seeing is tax return and w2.

@F A I’m seeing the way my attorney filled out the form and it’s pretty straight forward. If you look at Part 2 of the application you can see which option is applicable to you. I’m pretty sure one sounds out the most for you. I also want to point out that my attorney also selected the box “Select this box of Form G-28 or G-281 is attached” which should definitely be applicable to you as you have a licensed attorney who represents you. You will need to attached the filled out G-28 form along with your I-864W. Aa for supporting evident, it will be your VAWA application to show that you filed under the VAWA category.

I saw some people on this platform last year that USCIS requested I-864W and they got approved after submission

@F A your lawyer should have a file with all the paperwork he filed so he can double check if he missed filing that form

@F A oh,ok. I am sorry I had no clue about 864. My lawyer did everything so I never heard for this but I am so glad that other people helped you because they knew about this form.

@Mrkvica M. nothing yet. My rfe response has been delivered since but they are yet to update it. my case is still at “rfe sent”. I went to their office to get emergency AP, they said I didn’t come with a document so they didn’t stamp my passport but the officer that attended to me said he will email the document I presented and that they should approve my pending AP. 3days after, they approved my pending EAD/AP renewal.

Thank you my friend, I wanted to travel to see my father who is sick, but my sister has decided to travel since my card won’t be here on time. it was approved few days ago and I will have to wait about 2 weeks before getting the card itself. I thought I could get a stamp at their office. I’m just going to stay back and let my sister go handle things. thanks for your concern my friend🤗

While I am in this journey, my dad got really sick, now my sister is sick and i hope that her results will come fine now after surgery and all that adds to our stress. This is what I-864W Means, to show that the applying immigrant has adequate means of financial support without concern of becoming reliant on the U.S. Government for financial support.

My VAWA was approved in February and they received my medical exames in April. Tody my status changed to a new RFE. I got desperate and my lawyer told me: “I have checked your original AOS packet and indeed, the edition of the form at the time of filing had fused the form I-485 with the I-864W but later on the edition was updated again and the two forms were separated again”. Idk what did they ask, but I think is this form !

@F A Did you get your GC? How long did it take after you sent the form 864w? I’m asking because the same thing happened to me. They sent me a new RFE after my medical exams. I’m waiting the letter … I want to visit my family in January, so I really need to get approved until there. What do you think? Thank you in advance!

@Fernanda Teixeira not yet, you can download the form and sign it. Tell your lawyer to respond with that with a copy of your approved vawa. All vawa applicants qualify for the waiver

@F A I’m waiting my lawyer get the letter. I received the notification of RFE 2 days ago, so it’s on the way . yep, I’m gonna send my VAWA with my W-2, maybe .. I was waiting to see my GC being produced and now we have 1 more step. Hope to be approved until the end of the year. I really need to visit my family . @Fernanda Teixeira well from the comments I’ve read here, w2 isn’t necessary as all vawa cases gets the waiver.
