RFE - tips
Hi everyone! I recently received an RFE and had a meeting with my lawyers, but honestly, I’m feeling really insecure about the new strategy to demonstrate my value to the country. I have over 20 years of experience and hold two bachelor’s degrees, but USCIS is asking for more evidence. Has anyone else gone through something similar? Any tips on how to make my case more compelling?

@it’s me T it depends how your RFE look like? if its very aggressive then its better to withdraw petition and refile again via some good attorney

@mak dely my RFE my lawyer said it’s very generic, they don’t say if my reference letter are good or not, for example.

If your EB-2 NIW petition is based on a consulting practice or business venture, it is essential to demonstrate actual or imminent execution. No matter how strong your credentials or professional background may be, they alone will not be sufficient for approval. Under current adjudication standards, even someone like Einstein could be denied if their petition lacked a clearly defined and actionable project—this visa is not granted based solely on a strong profile, but rather on the merit and feasibility of the proposed endeavor.
Therefore, I strongly recommend including concrete evidence of activity: signed or pending contracts, letters of intent from clients, functional demos, collaborations with government entities, or any other documentation that clearly shows real execution or a serious commitment to carrying out your project
