Returned I130
Hi. I'm new to this site and I am just a little confused by the timelines. Our petition was approved in 2017. I am a USC and my husband is Nigerian. His visa was refused after interview and we received an email stating the case was being returned to USCIS for recommendation to revoke. The case was in transit for all of 2019 and most of 2020. It was received back at USCIS on April 13, 2021 @ Nebraska and transferred to Vermont SC on May 11, 2021.
I have been seeing cases processed with PD of April and May.
Anybody experience a returned petition at VSC that hasn't been processed yet?

unfortunately because your husband is from Nigeria, they will sit on your case for a long time

wow, that sucks. I mean I know they have a bad reputation in that country but we are legit and have all our documentation and proof that we are planning a life together. this makes me sad, but oh well...I guess we just continue to wait. thanks for responding.

hello I haven't experienced this but I don't feel so hopeful because my husband also lives in Nigeria and I know they are high on the USCIS list of suspicions

February can't come soon enough. so hard to be away from your loved one and can't experience moments as a married couple should. I don't like this process but I understand it. I just wish they would have a more reasonable processing time. I just sent in a I 129 just to have them look at my I 130. just being patient

we are planning a vacation to meet in Dominican Republic Punta Cana in May for my cousin's wedding. I'm hoping all goes well with that. we are trying to find him a flight that doesn't transit through the US

yes. that's a visa free country for them.

they just can't transit through the US without a B2 visa or a transit visa which is not easy for them to get

wow I never knew that. which airlines has direct flights? I just checked delta and that's a no go

there are no direct flights. he will have to switch planes once or twice.
so far I have only found flights on Lufthansa and Qatar. I'm not familiar with either of those airlines.

yeah make him see how long the plane ride is for once lol. that's what I want to do now because DR is only 3 hours from me. I'm gonna look into that, thank you so much for the info. let me know if you find a flight or something so I can look it up as well

yeah that's true, but may I ask why did they refuse your husband stuff in the first place?

we don't know yet. they don't tell you why at the Embassy. they send it back to USCIS and tell you to wait for a letter from them stating why and give you a chance to prove otherwise. we haven't gotten anything from USCIS yet. it took them over a year to send it back to USCIS...they just received it April 14 2021 so now we are waiting for them to send us notification of next steps.

some support groups told me that it might be because we married on my first trip there. but honestly I don't know yet.

I married on my first trip too. who wants to be spending so much money going back and forth. the first trip planning was horrible. a lot of money spent on shots etc etc. I live in NY and I had to drive all the way to Washington DC just to get my visa done. I knew Nigeria was gonna be a problem this is why I hired an attorney to handle this process for me. did you look into any attorneys?

No I hadn't looked into a lawyer until recently. I initially did everything myself. We were approved in like 7 months. Everything got messed up at his interview in 2018...we been waiting in Administrative Processing ever since.

my case is in California which has a 2-3 year processing time. that's why I filed the I 129 to see if they can look at my I 130. I'm in groups on Facebook and seen plenty of people get approved after they submitted that request

My husband is Nigerian as well, living and married in Turkey. I submitted paperwork 6/21… patiently waiting. Vacationing together in Colombia soon..

My husband is Nigerian as well and I really hope this process goes quicker then years. I might just file the I139F K3 and see if that speeds the process up. traveling there a couple times a year is costly.

yes Nikki praying for us all. We were looking at going to the DR on a family vacation to change up the scenery. After looking at flights though I am thinking the UK might be a better option.

The flight for him is through Lufthansa airline. He has long layovers on the return flight but he doesn't care.
I'm still trying to figure out the transit visa issue though. I am going to call the German Embassy on Monday since his layovers are in Germany.

when I fly to see him my layovers are in Germany...ugh I hate that airport and always miss my connecting flight.

I have never experienced their airport. I have flown into Amsterdam and I have flown into Paris. The other times I had straight flights from the US.
