Retrogression
so in September visa bulletin they mentioned “It is anticipated that the final action dates will advance in October 2024” but it remained the same. it’s been 2.5+ yrs they are still stuck with PD 2020 even tho they had more visa from family spillover + from last 2 yers they didn’t even accepted more applications so what’s really going on? AOS applicants are just 2k with PD 21 so why are they not moving forward? moving filing date to 22 may 21 is useless because everyone has already applied so what are they waiting for. all this retrogression does not make any point if they are still stuck and haven’t moved ahead.

it is roughly 4.5k AOS, even so the delayed is very not reasonable. Stop for 2.5 years only dealing with backlogs + a large number of AOS get approved in 2022, 2021, 2022 due to embassies closure. Even that 2023, 2024 were only focus on Consular processing. filing date 22 May 2021 is actually useless because PD 2021 all filed their I-485. The only think I see it advances is Philippines advances 7 months from May to December 2020. If thing moves like this PD mid 2022 can only file after 4 years as they move 4 months per year. This category is going so unreasonably bad with nonsense movement like we can’t comprehend their flows. Idk why they still let us why for what? Who is even behind those backlogs?

@sam young @Th Ng it's econ 101 supply and demand. it's not dependent on time. As of November 2023 there was 44,470 applicants waiting for a visa with NVC as of August 2024 USCIS has 7,177 pending I-485. With a maximum of 10K Greencard for the category so a 4 year wait time makes perfect sense the numbers add up. if your lucky you make get it in 3.5.

it's nothing personal they just don't want to break the law. Indian nationals has been experience this for a decade. They have file since 2012 and hasn't gotten their Green card. Because the visa bulletin is goverñ by 1 main rule supply and demand. since the supply is fixed the length of time depending on the demand. The more applicants the longer the wait it's that simple.

Election is the correct answer. Right now they are back peddling employment based and focusing more on marriage based and naturalization. Almost all EB’s are backlogged even though they have 130k visas available.

@hello mark if the total number of backlog is 40K+ don’t you think it should be resolved now because it’s been 2.5+ years which means 20K visas + extra visas they got from family category.

@sam young how would it be resolved if just NVC had 44K application in November 2023 let's not count the AOS to make the math simple. let's say they issued the 10 K green card allotted to the category. wouldn't that mean the have 30K application still pending? remember this is best case scenario because I didn't count AOS or any new applications since NOVEMBER 2023.

@sam young there is no extra GC for Eb-3 other workers. The category can't get more the 10K. so regardless how small or big the spillover gets EW can't get any.

yes, but law says not to give more than 10k to us. Out category is special.
