Retrogression and Religious Workers
Friends, I hear your frustrations on the recent retrogression in the EB-4 category, and I share them as well. When the first major retrogression occurred in 2022, I created a Twitter (now called X) page called Religious Workers Coalition. On this page, I regularly post about the challenges faced by the religious community, updates on the retrogression, politicians' responses, and related issues. We also share information about ongoing lawsuits filed by some churches against the government over this matter and how Senator Susan Collins and Senator Tim Kaine are currently working on a bipartisan bill to provide relief for religious workers. I believe the bill primarily focuses on allowing religious workers to remain in the country even after the five-year expiration of their R-1 visa. Our Twitter (now called X) page, with around 140 followers, is a growing community where we exchange ideas on this issue. Recently, we have been collaborating with International Broadcasters (who are also in the EB-4 category) to raise awareness. Additionally, we are developing a website, thebacklog.org (feel free to check it out), to provide further insight into the situation. I encourage you to join our community so we can share ideas and work together to find a solution.

I believe it is an excellent proposal to introduce a bill that enables individuals to remain in the United States legally after the expiration of their R1 visa (5 years). However, an additional consideration could be the establishment of a legal pathway for those whose R1 visa term concludes, allowing them the opportunity to apply for an alternative visa. Even after their R1 visa term (5 years) ends-this is the point.

when is the bill going to be introduced? 2025 eb4 visas are already over.. next month or so the annual limit will be reached and we will have to wait for 2026.

Also I understand that there’s a bipartisan bill being worked on, that focuses on extending R-1 visa beyond 5 years. But what about people like me, whose R-1 visa is already expired, I-485 stuck in pending cause of retrogression. Is there anything proposed like job transfer flexibility while waiting for our dates to become current?

We're all in the same boat. SA: The bipartisan bill in progress is being worked on by Senator Susan Collins and Senator Tim Kaine. The details of the bill are being kept under wraps, but some speculate that its primary focus will be preventing religious workers from having to self-deport when their R-1 visas expire. Additionally, there are unverified claims that it may provide some relief and flexibility for those waiting to receive their green cards. Please don’t quote me on this, as it remains speculation. The Trump administration has also indicated in the Federal Register that some form of flexibility and relief will be introduced into the EB-4 category in September 2025. Until the specifics are released, we won’t know what it entails (details about this are posted on our X page). Aside from these potential developments, the religious worker category currently does not have the flexibility to port to another employer. To obtain a green card, the law, specifically AC21 (please look it up), allows porting between employers when there is an approved I-140 and a pending I-485. However, religious workers are not included in this legislation. You must remain with your sponsoring employer until your I-485 is approved. This is my best understanding of the situation, but I strongly recommend consulting a competent immigration attorney if you are unsure.

good info but if you’re 485 is pending and r1 visa expired you are allowed to remain in the country as it’s awaiting decision.
