Report EB3 Other Worker Grand Total
AOS and Consular Processing total cases issued: 2017: 2832 2018: 3028 2019: 4310 2020: 5549 2021: 4885 2022: 8894 2023: 9315 I-140 received 2017: 3572 2018: 4182 2019: 5541 2020: 6193 2021: 7142 2022: 9271 2023: 9979 (I-140) - (AOS + Consular Processing) 2017: 3572 - 2832 = 740 2018: 4182 - 3028 = 1154 2019: 5541 - 4310 = 1231 2020: 6193 - 5549 = 644 2021: 7142 - 4885 = 2257 2022: 9271 - 8894 = 377 2023: 9979 - 9315 = = 658 2022 and 2023 granted total 18k GC but still not surpass the year 2020. If you notice the year 2021 approved 7142 (I-140s) but only issued 4885 GC. If they try to approved more GC in the year 2021 the backlogs would not stacked up. FY 2021 (Oct 2020- Oct 2021). Just my guess that it could be the problem for this long processing is on the year 2021. Every year the GC issued is quite close to the new I-140 submitted range from. so there is about 500-1200 cases won’t be approved the year after that but the second year which mean I-485 approved during this time is about 1-2 years. Only the year 2021 they approved so little 4800 GC which means about 2200 cases wait for next year to get approved and it is likely that we normally wait around 1 more year which our cases would be approved 2-3 years after filling I-485. Now the backlogs is 26k but about 16k for ROW that is by June 2023 but I only need it reach up to October 2021 which possibly around 17k and 8-9k for ROW which can issue all FY 2021 in just 1 year . FY22 + FY23 = 18k GC issued which can advance up to 2 FY but during FY22 + FY 23 they could not pass the year 2020 which imply 18k combine some backlogs far away in the past. Assume FY 24 is 8k issued we get 25-26k GC issues by October 2024 and by October 2025 GC issued is 33-34k issued. But If I added up 2019-2022 I-140s = 26k, by October 2025, there is no way that late PD 2021 could turn in 2026 to be issued. FY 2021 starts on October 2020-October 2021. So if the whole year 2021 is 9k and by October they finish December 2020, There is no way from October 2020 - October 2021 is more than 8k. So my guess is from October 2024-October 2025 they could take up the whole 2021 GC. I forget this I-140 approved does not count dependent of each I-140. My analysis is skewed.

its literally so shocking to know they are still stuck for 2020 for this long i thought they would atleast reach mid 2021 by the end if this fy but seems like it will be dec 2020 by the end of this fy
T
T NApr 22, 2024
@tribal chief maybe they try to resolve the most backlogged, if you use number of I-140 approved minus number of I-485 issued each year you would see a small portion would not get approved, that could be the backlogs they try to resolve now.
sam youngApr 22, 2024
@T N do you have any idea when date of filing will move for AOS ? because it’s crazy people doing AOS cannot apply for work permits or I-485.
T
T NApr 22, 2024
@sam young My guess is by October 2025 they could take up the whole FY 2021 and each year October is the month renewal quota, so they possibly advance the filing date by that time. Now they use chart A for filling I think they want to push something up. As there is no point to use filling date chart B if there is a huge backlogs, I guess when they try to push this, they could possibly change to use chart B filling date by October 2025 which is still quite long from now and it is actually crazy long.

T N tell me your prediction, when to expect the end (November) of 2022 to be current for unskilled?
T
T NApr 22, 2024
@Alex Kane it could possibly sometime in the late 2026 I think (October 2026 - December 2026), they could use the FY 2026 (October 2025-October 2026) to work on PD 2022
sam youngApr 22, 2024
@T N the process is so shit and slow. my pd is 7/22 and my I-140 is approved but due to I-140 being approved I can’t travel or drop my f1 status unless I have filled I-485. it’s totally unfair with people who are doing AOS.

2021 pd have about 18k cases will take 2 yrs oct 24 to oct 26. https://cis.org/sites/default/files/2022-10/WaitingListItem_2021vF.pdf
T
T NApr 22, 2024
@Y A there is 9k I-140 FY 2021 is from October 2020-October 2021 There is 9k new cases in there. How you count up to 18k, do you mean the 18k from now on?
T
T NApr 22, 2024
@sam young it is shitty and slow, I think someone had PD in April 2022 and able to file I-485. I think the backlogs now is from October 2020-April 2022. There is almost 10k cases in FY 2022, so I think by the time they issued cases in September 2021, they would switch to chart B filling date for PD mid 2022 to file. Yeah can’t image some F1 has to maintain status for about 2-3 years, that’s frustrating
T
T NApr 22, 2024
FY 2021 starts on October 2020-October 2021 and there is 9k new cases in there, by this October if they reach December 2020, I think about 2k cases would be resolved
Y
Y AApr 22, 2024
@T N click on cis link attached on above post 9k is only aos and conulate without dependents. link i provided is consulates only with dependents. on avg there are 2 dependents for 1 i-140 filed. total eb3 backlog on consulates only as of nov 2023 is 46k.

T NApr 22, 2024
@Y A You are right
the mankindApr 23, 2024
you have done very great work, according to your analysis what do you think for filling chart in oct 2024. my pd is mar 22 do you think the filling chart will move or not. please tell me
T
T NApr 23, 2024
@the mankind now USCIS is using final action date, I think they may switch to use filling chart date when they finish all cases in 2021, possibly in October 2025. This October 2024 may not use the filling date chart but keep using final action date chart
the mankindApr 23, 2024
so brother in this october 2024 pd they will not move the filling chart.
Y
Y AApr 24, 2024
@the mankind they will move filing chart based upon no of visa they will be able to use for that fiscal year.
the mankindApr 24, 2024
so brother what is your prediction since i can see you are pretty experienced, what do you think for this october
David LopezApr 24, 2024
thanks for your great analysis my PD is June 2021, we had the interview already with a positive feedback, do you know when we could be getting the GC?
T
T NApr 24, 2024
@the mankind Final action date October maybe January 2021 or February 2021
T
T NApr 24, 2024
@David Lopez I think you could get your GC April 2025 - June 2025 next year
Y
Y AApr 24, 2024
filing date could move till 2021 may jun this oct meaning we should complete half of 2021 next year then another half next fiscal yr.
the mankindApr 24, 2024
@T N brother my son is turing 21 after 1.3 years, i am also worried about his 485 filling so he can’t age out. what do suggest and think. i am waiting from 1.5 years but this filling has retrogressed.
T
T NApr 24, 2024
@the mankind there is a chance that he is gonna age out since this retrogression remains stagnant for so long, hopefully this October would have a big advancement in Filling Date or Final Action Date or if not, we have to see October next year, I’m also an age out child so I know it is frustrating to be in this situation but there is nothing but hope, usually October would have a big advancement except the last 2 years
the mankindApr 25, 2024
@T N brother where are you from? can i get your contact.
the mankindApr 25, 2024
@T N your i485 was filled or you kid become age out before that.
T
T NApr 25, 2024
@the mankind by the time the I-485 is approved, if your kid is already 21, he is considered it age out and cannot get the GC with you
the mankindApr 25, 2024
@tn if i filled i485 and during that my kid is under 21. so that he will be counted with me.
