Removal proceedings Update
hello guys , I need advice bcos I am loosing my mind , I have i130 approval a year ago and I am in removal proceedings . I submitted joint motion to ICE attorney for over two month now and my lawyer kept saying it’s pending . is there anything else I can do ? who has experienced such ? or my lawyer is lying he refused to pick my calls for a month now . thanks

@Omega % I have called court they have not terminated it maybe they waiting for the ice attorney to sign it . can I get approval from the court without ice attorney ?

freeman you will wait mine is now taking 11 months nothing and everything is pending I am so tired and i am sick so since November I still waiting

@Angelo Azac really 11 months? why ice behaving this way ? this is ridiculous .. what is the reason for hold it down for so long . ?

@ freeman, go to ice office and tell them about a pending request with there attorney to terminate dp.

@freeman 1- i don't if this would be of any help mine took over a year before judge signed the dismissal. I submitted my joint motion last year August and the judge signed my dismissal this year August with the help of my lawyer, they cant do anything. One thing my lawyer did was he reached out to the judge secretary and told them that i have been waiting for a long time. I guess that worked for me, but mind you every case is different and also judges are different. Mine was in NY

it’s also crazy that it takes a month or even less for some people, and for other people it can take longer.

@Mohammed Sunny thank you for your reply , well I guess I have to keep waiting . hopefully very soon they will approve it but I want to ask can a judge sign without ice attorney joint motion ?

@freeman 1 if you submitted a joint motion then as far as I know DHS has to agree and sign and then the judge signs. That’s how mine was DHS signed of and then it was transferred to judge and it sat there for quite sometime and after my lawyer reached out it the judges secretary that’s when I was accepted and placed in front of judge. I would say just sit tight you don’t wanna poke the bear too much..give it a couple of more weeks than you could ask you lawyer to reach out the judge clerk/secretary. Hope this helps

@freeman 1 you can file directly with the judge. read about Matter of Coronado Acevedo That clarified the issue that immigration judges have authority to terminate cases under such circumstances with or without the concurrence of the DHS my lawyer said judge can dismiss/terminate case without DHS joint motion.
