a removal defense attorney is able to move the court to dismiss the case based on your approved I-360.

Your attorney might be inexperienced in that area, when you have an approved Vawa,an application to dismiss or terminate your removal proceedings is filed with the immigration court.Shop around you’ll find good attorneys that will help you do it as fast as possible.

@Toya, when you have an approved VAWA and you are in removal proceedings, you have two options. One, is to use your approved 360 to file a motion to the immigration judge in charge of your case to terminate the proceedings so that you can go and adjust your status with USCIS. The 2nd option is that you can write to the judge to say you want to adjust your status in court which I believe is faster than USCIS especially when you have an approved VAWA (you can file motion for earlier date for the judge to adjust your status in court). To adjust in court, you will have to notify the court, file a copy of your I 485 to Texas Service Center and when the Texas service center issues you the receipt notice, you will file the original copy of the I 485 to the judge in charge of your case. After you have done the filing, you can file another motion to the judge to adjust you earlier than you current immigration court date. Please use an experienced lawyer to navigate all these.
