Remarrying While VAWA Is Pending: Can You Continue Working on Your Existing C09 EAD?
If you remarried a U.S. citizen while your VAWA-based I-360 and I-485 were still pending, what exactly happened to your existing work authorization?
Did you continue working while your new marriage-based I-130, I-485, and I-765 applications were pending?
My understanding is that remarriage does automatically dismiss a pending VAWA case; also the applicant must formally withdraw it. However, if you withdrew your VAWA petition, did your existing C09 work authorization remain valid temporarily because USCIS had not yet processed the withdrawal or closed the VAWA-based I-485?
More specifically, were you legally permitted to continue working with the existing, unexpired C09 EAD until USCIS formally terminated the underlying VAWA-based I-485 or approved the new marriage-based EAD?
The new application would be based on marriage to a U.S. citizen. I have consulted several attorneys, but I have not been able to get a clear and consistent answer. I would especially appreciate hearing from anyone who personally went through this situation.

you are so brave to risk doing that and losing the benefit of vawa if your new spouse should ever turn against you, God forbid. Once USCIS gets an update about the marriage, it will automatically cancel all benefits tied to vawa.

same with me I have consulted multiple lawyers specifically for the same topic and the approach is as if it is not a big deal. almost all of them have been confident in saying you can work till the EAD expires..which is kind of questionable

you cant work with this ,in the moment that you are married your vawa case is closed, so every document that you took from vawa is not working anymore,I have 1 year with work permit c09 and now I need to wait for a new ead from vawa case😢

@Ivan b Vawa is very unpredictable, no one truly knows for certain when they’ll get an approval. It would be one year later, or less. But to answer the question, once again — if you get married while you’re vawa is pending, you will lose all benefits including work permit. If you choose to work with it until it expires or until USCIS sends out a NOID/denial letter it’s really up to you.

It’s not that no one wants to give you an answer; it’s just that the situation is crystal clear right now. Even if your relationship is genuine, officers can demand a great deal of evidence and dig deep—even where no proof exists. If even one thing goes wrong, your VAWA case could automatically collapse, and your file will be put on hold until they are convinced you aren't just seeking an immigration benefit and are 100 percent certain there is no fraud involved—even if that isn't the case, that is the hurdle you face.

don’t worry don’t withdraw my idea just file marriage green card same time, congratulations you will get your marriage green card in one year you don’t have to worry about you can withdraw after that. if they cancel let them do. you can file so many cases same times. why they are canceling when you marry because they dont wanna give another immigrant vawa base green card my idea. you married citizen if you trust her and genuine love between don’t worry. my friend got her green card in 8 months total last year.

I have a pending VAWA petition, and I have since remarried and filed an I-130 and I-485. I am still working using the EAD associated with my VAWA case. My EAD expired, and I filed for renewal four months ago.
My VAWA petition is still being processed, as I continue to receive PF extensions. I also recently received a case update stating that correspondence was received, which I understand may reflect internal activity on my case.
