REMARRYING AFTER VAWA APPROVED
I filed for Vawa on January 2020, my Vawa Petition was approved on August 2022. I filed for divorce and it was finalized on April 2024 and on August 2024 I re-married. As of today (October 2024) my adjustment of status through Vawa still pending with no updates. It’s been over 2 years since my vawa (I-360) was approved. My Question is, can I file a new green card application through my current husband who is a US citizen ? I already opened a request for my Vawa case out of processing time but I never got anything back. I see a lot of cases of Vawa getting the green card within 1-2 years I don’t know why my case is taking too long. I need an advice if I can file a new green card application based on my current marriage because my daughter is my dependent but she turning 18 next year, when I filed for Vawa she was only 12.

once VAWA approved you are free to remarry. It won’t affect your green card but you cannot file a second green card application

@lore S let congressman reach out for you. it does not matter your daughter is going to be 18 soon. you have until she it 21yrs old. please try more to check on your vawa case once u remarry your vawa case is done with..I really hope thus new guy don't play any games with you.😏

you can but the vawa privileges will be revoked and you will be subjected to a new USCIS process that does not involve as much pardon as the current application you have pending, if I were you I’d wait until the vawa is approved to continue that process. you will be subject to financial and other requirements that are more strict…

@Lore, you can remarry after your VAWA I 360 is approved. You can also remarry before the I 485 is adjusted but it would have been better if you have waited for all the petitions pending to be adjudicated before you remarried. If I were you, I will wait for the VAWA I 485 to be adjusted. Marriage I-485 is more stringent and requires a lot. Reach out to USCIS office where your I 485 is pending and ask what is going on. Write a letter to them. You can also escalate with the help of a congress person or a senator. Be patient before you go put yourself in more mess. Patience is very crucial to avoid making hasty decisions that will cause more complications.
