Received Green Card through parent and married right after that
I have recived the green card through my dad ( F2B unmarried son over 21 years old ) by adjusting my status as I was on F1 visa. After having the green card in hand I got married after two weeks to my then girl friend who I known for 7 years ( no weeding, only ceremony with close friends and family in court). Now, I have submitted I-130 and I-485 concurrently for her as she is an F1 student. Just to mention that we lived on and off with each other and shared leases during those 7 years as much as possible like lived toghter 3 years and then went to a different schools and we live back toghter because of the pandemic and school is online. Also, we have joint car insurance and credit card since almost 6 years ( now have joint bank account, health insurance). My question is, would the officer ask a question like, why did you decide to get married two weeks after receiving your green card? I know by law that there is nothing wrong with that at all. But if so what would be the answer for that? Would I have a hard time overall about that.

I don't believe you'll have any issues with that. It would be a problem if you got your GC through marriage and somehow got a divorce and decided to file for another person. Good luck with everything.

ohh sorry! it was only me in that interview. The first one, the officer was not super nice, I would say she was not familiar with F2B and first things said that “ I usually interview couple, parents, work “ never F2B. At the time of the interview my priority date was not current but she did not even mention that. Other weird question “ how your dad get his green card?” then ask the yes and no questions even the weirder thing in the Yes and No question she would ask them like “ did you or any of your family member …. “ The second interview was in a different state since I moved, the officer was super nice, she hold a PhD degree. the interview took less than 15 mins and she started by saying the relationship was already established in I-130 and already approved long time ago and do not need to talk about it and then ask me what I do for living. then couple of the Yes and No and while I was driving home I recived “ card was produced” Good luck on your interview

@ Adam T I have an interesting question for you Please, I understand you were on F-1. Did you keep your F-1 statue the whole time? or were you out of statue while you were waiting for your I-485 to be approved?

@spechless I kept it the whole time. But my understanding that legally once you submit your I-485 and USCIS received and aknwolged by a receipt, then you do not have to keep your status. However, you are to stay but not to work until you receive your EAD card. Hope that helps!

@Adam T Thanks bro. But I submitted I-485 after i was out of status. Do you think this will be a problem when I will go to the interview the reason I applied I-485 after is because i was waiting for my visa to be current.

@Speechless honstely, I have no idea. I thought that if you were out of status then they would not accept your application in first place as F2A has to maintain a status until priority date become current and submit I-485 ( unless your spouse is US citizen). So, maybe it is a good news that they have accepted your application. so, I am wondering that while you were filing I-485 which status you used since you had no status at that time. I wish you all the best and hope that everything will go well for you.

@ Adam T i had a F1 student visa at that time, but when I graduated from university, my priority date didn’t become current. So my I-130 was approved 6 months after graduation and I waited 6 years, when my date become current… visa is available letter approval from NVC and then I applied for I-485 on June 09,2021, I already did biometric fingerprint on July 12,2021. now i am still waiting for interview. that’s why i want to know if this gonna be a problem when i do my interview. my case is F2B My Dad is LPR

@sppechless So my understanding that you overstay your visa while waiting on your priority date to become current? Is that right? For how long you have been out of status ? In other words how long between your graduation and submitting I-485? Having I-130 approved means nothing when priority date not current and does not give the legal right to remain in the US. I am not fan of lawyer but I would recommend that you consult with one immediately.

I have never heard of paying fees for staying out of status! That is news to me! You may want to read here and see what fits you https://www.uscis.gov/policy-manual/volume-7-part-a-chapter-2

Hi Charlie, my priority date was Sep 21 2019 and the first interview was scheduled on Jan 15, 2020.
