Re-enter inside US using AP, and existing H1B validity which is beyond AP
I have I-485 pending, waiting for EAD and AP cards. Planning to travel outside US once received AP, and H1B transfer approved (in progress) which will have 3 years validity i.e. until 2026. My question is if I travel and re-enter with AP, I can continue to work for the employer using my existing approval; and what would happen when my AP is expired in 1 year? Will it automatically go back to H1B with my existing approval or need to file again or something else. Appreciate if any experience or clear answers. #AP #travel #h1b

not sure about that as I haven’t re-entered US using AP, but I think one should use visa as the first choice and AP should be your last resort. I understand that once you’ve used AP then you’re tagged as parolee to I-485 pending and you lose your visa status…(that’s what I understand and I might be wrong). my AP is valid for 2 years and understand that one needs to reapply for renewal before the expiry

yeah, i have heard the same thing. The first preference should be H1B visa. This is beneficial and the 60day grace period comes in handy if you are laid off.

re enter under H1B, it’s better. don’t use AP unless your H1B expires.

yeah, but the real issues are getting VISA stamping appointment 😂
