Quit the job after 1 year of contact
Hi everyone, I just have a quick question. My question is I finished 1 year of contact with my sponsor, now I am thinking about can I quit the job at all after 1 year or I need to work just 1-2 days/week to maintain the paycheck? Because I haven’t received my GC yet, so I scare in the case if USCIS send me a request to ask about my lastest paychecks to show them the evidence that I worked for my sponsor, and then I don’t have it because I quited after 1 year. What should I do with that case? Any recommendation? Thank you in advance!

do you have another sponsor?if you quit on your sponsor without the GC then your sponsor might withdraw it.

@J A No, I don’t have. I just thought I quit and look for another job. I thought because I worked for them and complete the contact and they cannot do anything to my GC.

You might have a problem there. If you quit your job your sponsor will withdraw your petition. I suggest you talk to your attorney to inform you on this. I would not suggest quitting your job especially from your sponsor until you get your GC.

@J A no way they can do anything with your case once it has crossed 6 months of pending i485. @bounty n you can just find another sponsor and submit i485j form if you wana continue work till GC

That is the reason why you need another sponsor to protect you. This will give you some leverage in case your current sponsor withdraws the petition. I know you cannot withdraw the petition once it is already 180 days pending but in order to have that extra cushion you need to find another sponsor on the same job description for you to file 485j.

You are all set. If your I485 is filed more than 6 months, your employer cannot withdraw petition.

@J A actually it doesn’t even matter if @bounty n has another sponsor or not also. @bounty n can leave the job anytime and sponsor cannot withdraw petitions. just in case if USCIS sends rfe kr comes for inspection is the only case else.

@Mr X Yes, that’s what I scare and think about if USCIS sends RFE and ask some paychecks to prove that I am working there. But if I quit after 1 year and I don’t have it then, I think I will get trouble with USCIS.

@Mo Salah My case was submitted on Sept 21 and it’s almost 2 years this year. I already completed 1 year with my sponsor and I just had a concern about maintaining the paycheck or not.

@J A stop misleading these guys please and please! He has fulfilled his 1year contract and he can leave! AGREEMENT IS AGREEMENT NOthing your employer can do to you! And what @Mr X said is true You need another enployer that can sign your I485J for you which is the easiest one to get an employer to sign And you don't need to submit your I485J to USCIS Have your new employer sign it and keep it incase USCIS asks you for RFE/interview before your GC is approved

@Kim kim then USCIS will send you NOID at worst! Which is very rare! They would rather send you an RFE to confirm the offer with your sponsor is still valid. You should know, I485 is judged based on ability to join employer after approval. YOU DO NOT HAVE TO WORK WITH YOUR EMPLOYER BEFORE I485 APPROVAL Even right on I485J... On the reasons you are filing I485J, option 1B states that Request job portability under INA section 204(j) to a new, full-time, permanent job offer that you intend to accept when we approve your Form I-485 So I485 is approved based on INTENT to work with your employer after approval.. not before! USCIS will have to ascertain you CLEARLY DO NOT WANT TO WORK WITH YOUR EMPLOYER AGAIN, THEY WILL NOT JUST DENY Back to first scenario .. if they send you NOID, RFE or call you for interview.. then you can send in your I485J If you are scared of NOID/RFE... then send in your I485J as soon as it is filed. Some of us ain't scared... USCIS ain't gods... they don't make irrational decisions

@Kim kim I didn't finish my 1year contract with BDV... Hell no... didn't even do 3months They sent threat... ofcourse what would carrots do than threats? I have called their bluff and told them to go ahead! I'm waiting

If your PD is 2020... I'd say ride it out as you might get it by the end of the year My pd is late 2021... there's no hope for me till late 2024 at best... not gonna be stuck doing some lameass job I don't like It's a marathon not a sprint... gotta look out for myself

I found another job Spoke with the HR that I have a pending greencard application and just need to report to US immigration that I am switching job so they can know who I am working with All you need from them is Employer ID, NAICS, SOC, Numner of employees, employment address, lastyear income and HR signature. The first 3 are usually easy to get without even asking the HR

@Kim kim I did myself.... I485J is very similar to intial I485... and I485J is very simple also. There's really nothing to the form... these paralegals are just cashing out. There are tons of videos on youtube
