Questions please! F2A
My questions are summarized as follows so that you may not have to re-edit
my father is a green card My classification is f2a My birthday is December 6, 2002
I submitted Form 130 on November 1, 2022.11 (one month short of 19 years old at that time) and Form a was not scheduled at that time and I am waiting abroad now Form A has backlogged my question is
1. May I ask whether my classification f2a falls under the cspa Child Protection Law?
2. Does the Immigration bureau automatically calculate the compensable time you mentioned or do I need to submit any documents?
3. If I approve 130 six months later (that is, it will take a total of one and a half years), if the schedule of Form A has not arrived by then, will I enter nvc and have an interview?
I understand what you mean: If the schedule is restored to no schedule within the compensation time, I can continue with this. Is my understanding correct? Thank you for your answer!

you do qualify under child protection law. After your I130 gets approved you have to review the visa bulletin to continue with process. I advise you to check the uscis website for more information or get a lawyer to help. Best of luck Rebecca 👍 ✨️ you are in the right path

@Yevi Lu hi so my son was around 20 when i filed for i130 petiion in may 2021 and few days back got naturalized and requested to upgrade my i130 so now will it be upgraded to ir-2 or f11.also, first it was considered in f2a category but i have now requested to upgrade to ir-2 so now will it be considered ir-2 or f11 if it’s consider as f11 can i opt out to f2a and can i qualify under child protection law?

@Yevi Lu currently he is 22 the petition is still not approved and i have put a request to upgrade i-130 he was 20 when the i-130 was submitted

@Saurav Singh Yes, you can qualify under child protection law. that is a plus in your case. Because this category takes a little longer than usual. Hopefully with the update you can get your I130 approval 😉.

@Saurav Singh Ok. In order to know exactly we need to have the I130 approved. the actual approval with the Child protection law. USCIS will make the determination. all depends on your approval. I hope you get an approval.
also another factor will be your country of origen. please do a deep research on the visa bulletin process so you can have a better idea of what is your time frame.

@Yevi Lu i contacted USCIS through emma to know my current case category so they said it’s ir-2 for my son. they have recently send me a rfe if i get a approval for ir-2 would that work as ir-2 category in nvc as well.

@Yevi Lu when a permanent resident petitioner becomes a naturalized u.s. citizen, his i-130 petition for a minor child who turns 21, but is protected by cspa, will convert from the f2a to f1 category. if there is more backlog in the f1 category, can he opt out to f2a? what are the possible ways now?

@Saurav Singh all depends on the priority date. as a citizen your application changes but you have 50/50 chance.
I know this is very difficult when you talk about bringing a family member but there is always loopholes on the equation. you are in the right path.
