Yes you can apply for B visa. visitor must show that they will return to their country and not have immigration intent at us embasy. also CBP will want the same information when you arrive in USA. No not lie to embassy or CBP.

you can try but most likely they won't give it to you best of luck whatever you do don't lie on your application it will come back to hurt you

I did not get a B1B2 visa and they did not even check my evidence. they asked about my husband and asked if I have a I130 pening. after that I got denied

@Rebecca horn well thanks for the reply I hope you get i130 approved soon, I also considering not to apply for visitor visa because of very less chance to get approved while pending petition

My hubby tried to come to the US to visit me from India while our I130 is still in process. He got rejected. We started our I130 application on Dec 2021. Hoping to see the light at the end of the tunnel soon.

I luckily got approved for a visitor visa but because I was pregnant (living in Canada) I said to the officer that I was going to give birth without paying a penny and for sure I was going to return back to CA ( which I did)😅. so he approved it and told me that’s a common thing ppl waiting for a migratory application do in order to avoid the processing wait time. So they look these type of situations extra carefully and they likely deny the visitor visa application. 🥲 I hope your visa gets approved soon🙏🏼
