Proving nonimmigrant status RFE i-485
Hi everyone,
Pls advise. I received an RFE for my EB3 i-485 asking to submit evidence that I maintained nonimmigrant status for a specific period of time before I applied i-485. The thing is by that time my another i-485 for EB2 NIW was pending and I have all receipts and everything.
So can I use those EB2 niw receipts as my legal status proof?

receipts are not a proof of status. When filing for i-485 you should be “on status” that is what they are asking.

no the receipt can't be used as proof. depending on what your non immigrant status was that will show proof like I-120 for F1. also can submit your I-94 to show you you were in valid Non-immigrant status on the day you filed your I-485.
