i130 filed with USCIS, April 12 2022
i485 eoir filed with Court April, 28 2022
i765 filed with USCIS, May 05,2022.
Request for Prosecutorial discretion with ICE june 2022 ( granted after 36 days)
Joint motion to Immigration judge for dismissal July 2022( granted after 25 days)....
You dnt need to wait for i130 to be approved before requesting for Prosecutorial discretion.

I called my lawyer immediately he is filling today i130 has been pending since September. I can’t believe how much time I wasted waiting.

I knew that pd could be granted without needing approval of the i130 but I didn’t know if you can get your case dismissed/terminated without an approval, well u guess that’s new

@tm, Lawyer did everything. Not advisable to request PD by urself, let Lawyer handle it for you...

thanks @Kay when I spoke to him he said yes of course we can file b4 the i130 is approved I was like so I didn’t you say anything for the past 11 months he said he would prefer to have an approved i130 I told him to please file today.

I already have pd what I need is to get the case terminated but my lawyer say u can’t request termination without i130 approval before it will most likely get denied but after seeing your post saying it’s possible I need to talk to my lawyer about this again because pd doesn’t mean my case terminated it just off the calendar and they can put u back on calendar anytime meaning I’m still in deportation until the judge terminated the proceedings

Most of the attorney are meant to waste someone time. You need to tell them wat to do b4 they do it. I asked my attorney to request for PD before she did it. PD was not effective then, it was brought back around April or May this year, so most lawyers didn't knw abt the recent news..

God's plan If you can get your attorney to make a nice file with a nice letter asking DHS to terminate the proceedings against you will save at 1.5 year of wait time. so when you go to your I-130 interview they can adjudicate your i-485 the same day. PD is possible and you can get it even if your i-130 hasn't being approved

thanks @abdou my lawyer sent the pd to dhs last week now we just waiting for them to agree then we’ll send to to the judge after but in the meantime my EAD got approved last week also and I received my ssn and ead in the mail yesterday 🙏🏽 so now I’m just waiting for interview hopefully I’ll get my case terminated before I get an interview date
