Pro Se Mandamus — Who Should Be Named as Defendants?
I’m planning to file a pro se mandamus/APA case regarding a delayed I-485. I live near Sacramento, California, but when I contacted USCIS, they confirmed that my case is currently being handled by the Queens, New York Field Office.
For a pro se filing, who should I name as defendants? Should I include USCIS, the USCIS Director, the DHS Secretary, and/or the Queens Field Office Director?
I’d appreciate any guidance, especially from anyone who has recently filed a similar mandamus case.

I filed my own I-485 mandamus case pro se. One important thing to understand is that the defendants you name and the service requirements are two separate issues. Since you live near Sacramento but your case is currently being handled by the Queens Field Office, I would first verify the proper venue under 28 U.S.C. § 1391(e). I would also review recent I-485 mandamus cases filed in your federal district to see which USCIS/DHS officials were named as defendants. I’m not an attorney, but I can share my personal experience and explain the steps I followed in my own case.
