yes that is what I believe too. if the my priorities is based on LC (September 2020) then my case is current. But if it base on the date I filed I-140 than I have to wait prop two more years. I dont know why I called USCIS two times already to verify this, but both of them say priority date is the date I filed I-140. Super confusion

That’s not true.Family based and employment based PD are different. For employment based, PD based on. that date you submitted your labor certification.

@Alex brown from the point I know you are right . for those with sponsor PD is when LC submitted . All attorneys I watch say this . so they on chat know less than us , immigrants

if you wanna make sure your pd, you can see your pd on the I-140, it is written on the I-140 letters, and I believe PD is the day your LC was filed.

It’s considered the PD with I-140 file date for EB process that doesn’t have a Labor Certification, like EB-2 NIW. For EB-3 it’s considered the LC file date.

it is LC file date which is considered as PD for Eb3-unskilled. So they are wrong about giving you that info.

They don’t even know what they had for breakfast. USCIS is messed up. I’ve seen so many huge mistakes and it scares me, so I don’t know what to expect anymore. PD 08/05/20 and nothing so far.

A lot of mistakes…. My priority date is 06/29/2020 and it is confirmed in my 140 approved notice so someone put the wrong date in my case, they put the same date of my 485 receipt date (February 2021) so for them my case is not current because their error and I am current since out 2023 and nothing happens. The attorney sent 2 inquiries and they didn’t fix it. Yesterday I call USCIS and my PD still wrong on the system… So frustrating it.
